The Board of County Commissioners, two members and the County Clerk present, met in regular session at 9:00 AM.  Commissioner Tucker was absent.

CALL TO ORDER:  Commissioner Lewark-Wood.

INVOCATION:  Commissioner Fowler.

PLEDGE OF ALLEGIANCE:  Commissioner Lewark-Wood.

AGENDA APPROVAL:

 

ACTION A motion was made by Commissioner Fowler to approve the agenda as amended.  The motion was seconded by Commissioner Lewark-Wood.

     ROLL CALL VOTE – Commissioner Lewark-Wood - Yes

                                                   Commissioner Tucker - Absent

                                                   Commissioner Fowler – Yes

APPROVAL OF PAYMENT OF INVOICES:

 

ACTION:  A motion was made by Commissioner Lewark-Wood to approve invoices in the amount of ­$667,670.86 and $14,370.95 as presented by the County Clerk’s office.   The motion was seconded by Commissioner Fowler.

    ROLL CALL VOTE – Commissioner Lewark-Wood - Yes

                                                   Commissioner Tucker - Absent

                                                   Commissioner Fowler – Yes

JUDGE CANADAY – INDIGENT AGREEMENT CHANGES:

 

Judge Canaday presented modified agreements for indigent legal services provided by Jeffrey Gettler, Jeffrey Gossard, and Tiana McElroy.  The modified agreements do not change the total amount paid to the three (3) attorneys but only readjust the duties for each one.  The following action was taken:

 

ACTION:  A motion was made by Commissioner Fowler to approve the modified agreements for Jeffrey Gettler, Jeffrey Gossard and Tiana McElroy providing indigent legal services for District Court of Montgomery County, Kansas.  Motion was seconded by Commissioner Lewark-Wood.

                                                   Commissioner Tucker - Absent

                                                   Commissioner Fowler – Yes

PUBLIC WORKS:

 

Robert Bever, Public Works Coordinator, presented the weekly written report.  The following items were discussed:  5-Year Bridge Plans; FEMA damage site assessment on damages incurred on May 26th; and Major Bridge Replacement Status.

 

No action was taken as a result of this report.

SHERIFF:

 

Sheriff Stan Veach met with the Board and discussed a problem between neighbors at the Oklahoma State Line.  One of the individuals is in Kansas and the other in Oklahoma (CR 4500).  One of the individuals address is 4351 CR 1200.  The problem appears to be a civil matter.

 

Sheriff Veach told the Board Detective Ron Wade is getting an estimate on radio battery backup for the repeaters.

 

Executive Session:

ACTION:  A motion was made by Commissioner Fowler to recess to Executive Session at 10:30 AM to return at 10:40 AM with Sheriff Stan Veach present to discuss non-elected personnel.  Motion was seconded by Commissioner Lewark-Wood.

    ROLL CALL VOTE – Commissioner Lewark-Wood - Yes

                                                   Commissioner Tucker - Absent

                                                   Commissioner Fowler – Yes

 

Returned to session at 10:40 AM with no action taken and no decisions made.

OTHER COUNTY BUSINESS:

  1. Jim Shontz, County Appraiser’s Office, explained the sales ration compared to what the County Appraiser has for 2007 ratio and it is 89% of the sale price. 
  2. Letter from Buzzi Unicem USA Inc. regarding closure of facility.  This letter has been made a part of the minutes of today’s meeting.
  3. Urgent Need Grant Administration Contract for signatures of the Board.
  4. Spill Report from Montgomery County Environmental Health Department.        
  5. Jim Miller present an estimate from Washington Electronics, Inc. for radios and miscellaneous supplies including installation in the amount of $6,589.64.  He advised the Board this amount will be paid from the 911 Funds.
  6. Acknowledged Montgomery County rural Fire District #1 minutes of the April 15th meeting.
  7. Department of Corrections Monthly Report.
  8. Acknowledged letter from Secretary of the Interior, Washington regarding Payments in Lieu of Taxes for the Fiscal Year 2008.  Montgomery County’s share of the payment will be $29,255.00.
