The Board of County Commissioners, three members and the County Clerk present, met in session at

7:00 PM.

CALL TO ORDER:  Commissioner Lewark-Wood.

INVOCATION:  Commissioner Fowler.

PLEDGE OF ALLEGIANCE:  Commissioner Tucker.

AGENDA APPROVAL:

 

ACTION A motion was made by Commissioner Fowler to approve the agenda as amended.  The motion was seconded by Commissioner Tucker.

MONTGOMERY COUNTY RURAL FIRE – BY LAWS:

 

Wilbur Schwatken, Montgomery County Rural Fire Coordinator and Randy Haymaker, Montgomery County Rural Fire Board President, met with the Board to discuss revised by-laws for the district.

 

There were 15 individuals in attendance associated with the Montgomery County Rural Fire Departments.

 

Mr. Schwatken asked for approval for a Christmas Fire Dinner to be held at the Dearing Church and to be catered by K&B Drive Inn on December 4th at 6:30 PM.  The Board approved the request.  Mr. Schwatken extended the invitation to attend the dinner to the Board on behalf of the Rural Fire Department.

 

Mr. Haymaker presented copies of the amended by-laws to the Board.  He stated the by-laws had been approved by the Fire Board 4-2 with 1 abstaining.  Some of the changes included the following:

 

Mr. Haymaker said he had used the Dearing Station bylaws as part of the guideline for the District bylaws and had incorporated from other stations.

 

When the Independence Fire Station representatives questioned and disapproved of the wording in giving the Fire Board authority to discipline and or remove individuals including fire chiefs and other officers, Mr. Haymaker said he was tired of defending the actions of the fire stations when the Fire Board has no authority to “do anything about it”.

 

Commissioner Tucker requested a set of bylaws, a set of operating procedures, Fireman’s Relief, and a set of SOPs be prepared, each individual documents.  These documents are to be compiled by Randy Haymaker, Wilbur Schwatken and the representatives from the seven divisions.  No time limit was set for these to be completed.  Once completed and approved by the Fire Board, there will be a meeting with these individuals and the Board of County Commissioners and the approved changes will be presented.

ENVIRONMENTAL HEALTH/ZONING – REMOVAL OF STRUCTURE ON SEWER DISTRICT EASEMENT:

 

Mr. Scott Barnhart, Environmental Health/Zoning Administrator, discussed the non-conforming structure being built on the Sewer District No. 2 easement.  The individual had not applied for the proper permit before placing the structure. 

 

The Board instructed Mr. Barnhart to have the individual remove the structure and go through the proper zoning procedures with an application.

PUBLIC WORKS:

 

Mr. Robert Bever, Public Works Coordinator, met with the Board along with Mike and Karen Deal regarding the road closing request by Mr. Roberts at a previous meeting.  Mr. and Mrs. Deal stated if the road is closed it will close some of the access to their property.  The following action was taken:

 

ACTION:  A motion was made by Commissioner Tucker to not vacate CR 1600 between CR 1700 and CR 1900 as requested on October 22,2007 at the Board of County Commission Meeting by Mr. C. M. Roberts.  The legal description is as follows:  A portion of Road 948, as described in Road Record Book 3, Page 454 in the Montgomery County Public Works Office and more particularly described as follows:  Beginning 700 feet from the road right-of-way of the Southwest corner of Section 3 and the Northwest corner of Section 10, Township 35S, Range 14E of the 6th Principal Meridian, Montgomery County, Kansas, thence west approximately 1940 feet and there ending.

The above described road having a 33 foot right-of-way.

 Motion was seconded by Commissioner Lewark-Wood.

No Parking signs have been requested at the Lehunt gate.  Mr. Kurt Jabben has complained he cannot get through with equipment due to the parking at the gate.  The following action was taken:

 

ACTION:  A motion was made by Commissioner Lewark-Wood to authorize the Public Works Coordinator to place “No Parking Signs” at the Lehunt gate site on CR 5000 Mile 12 Section 10 Township 32 Range 15E leading back to the Lehunt area.  Motion was seconded by Commissioner Tucker.

The Board approved moving the bridge project on West Eighth Street at Coffeyville to year 2013 or year 2015 on the planning list. 

 

OTHER COUNTY BUSINESS:

 

  1. Paul Benson talked to the Board on roads needing work.
  2. Acknowledged Barbara Hinthorn’s call regarding the buy-out by the county in the flood area.  Ms. Hinthorn is against the county spending money on this project.
  3. Executive Session – Requested by Commissioner Tucker –

ACTION:  A motion was made by Commissioner Tucker to recess to Executive Session at 8:50 PM to return at 9:00 PM with the Board present to discuss non-elected personnel.  Motion was seconded by Commissioner Lewark-Wood.

    ROLL CALL VOTE – Commissioner Lewark-Wood - Yes

                                                   Commissioner Tucker - Yes

                                                   Commissioner Fowler – Yes

Returned to session at 9:00 PM with no action taken and no decisions made.

4.      Holiday Vouchers –

ACTION:  A motion was made by Commissioner Tucker to increase the Holiday Vouchers by $5.00, from $25.00 to $30.00 for 2007.  Motion was seconded by Commissioner Lewark-Wood.
