The Board of County Commissioners, three members and the County Clerk present, met in regular session at 9:00 AM.

CALL TO ORDER:  Commissioner Lewark-Wood.

INVOCATION:  Commissioner Fowler.

PLEDGE OF ALLEGIANCE:  Commissioner Tucker.

AGENDA APPROVAL:

 

ACTION A motion was made by Commissioner Fowler to approve the agenda as amended.  The motion was seconded by Commissioner Lewark-Wood.

APPROVAL OF PAYMENT OF INVOICES:

 

ACTION:  A motion was made by Commissioner Lewark-Wood to approve invoices in the amount of ­$518,213.18 and $15,000.00 as presented by the County Clerk’s office.   The motion was seconded by Commissioner Tucker.

APPROVAL OF MINUTES:

 

ACTIONA motion was made by Commissioner Tucker to approve the minutes of­­­­­­­ September 24, 2007as amended and as presented by the County Clerk.  The motion was seconded by  Commissioner Tucker.

COMPUTER DEPARTMENT – KEN COLLINS & JASON CLUBINE:

 

Ken Collins, Computer Department Director and Jason Clubine met with the Board to provide information on cost to the county for software used by the departments including the Orion System which was CAMA.  The total cost to the state for Orion and R.V.I. for software maintenance is $6,450.00. 

 

Spam filtering software was discussed and the Board approved purchasing the software in the amount of $642.60 per year.

APPRAISER’S OFFICE – CONTRACT WITH PROPERTY VALUATION DEPARTMENT AND MITIGATION FIGURES:

 

Kathy Craig, County Appraiser’s office advised the Board that neither she nor Jim Shontz will be permitted by the State Property Valuation Department to sign certain documents required.  At the present time several State Board of Tax Appeal documents are ready to be sent to PVD and must be signed.  She presented a contract between Montgomery County and Kansas Department of Revenue for Mr. Lawrence H. Reynolds to assist the County and “manage the office of county appraiser” until an appraiser can be hired to fill the vacancy of Mr. Kline.

 

The contract will be forwarded to the County Counselor by Ms. Craig to review and will be tabled until an opinion has been given to the Board of County Commissioners by Mr. Kritz.  The following action was taken:

 

ACTION:  A motion was made by Commissioner Lewark-Wood to approve the contract, if approved by the County Counselor, between the Kansas Department of Revenue and Montgomery County for Mr. Lawrence H. Reynolds to assist the County and “manage the office of County Appraiser” until an appraiser can be hired.  Motion was seconded by Commissioner Tucker.

Ms. Craig presented valuation figures for the flooded area in the rural area plus a 10% increase as previously discussed by the Board if they proceed to offer the “buy-out” to those residential structures with 50% or more damage.  A total of 33 residences and three (3) businesses were included in the figures.  There could be more added later that the County Appraiser’s Office has not been notified of or knows about.

 

Executive Session:

 

ACTION:  A motion was made by Commissioner Fowler to recess to Executive Session at 9:37 AM with Kathy Craig present to return at 9:45 AM to discuss non-elected personnel.  Motion was seconded by Commissioner Lewark-Wood.

    ROLL CALL VOTE – Commissioner Lewark-Wood - Yes

                                                   Commissioner Tucker - Yes

                                                   Commissioner Fowler – Yes

 

Returned to session at 9:45 AM with no action taken and no decisions made.

PUBLIC WORKS:

 

Robert Bever, Public Works Coordinator, met with the Board to discuss the following:

 

  1. Status change for employee completing 90-day probation – Approved by Board
  2. Asphalt report and reported they are now working on Sunflower Road
  3. Presented fee report for September
  4. Reported on Sweeney Hill accident that has been in litigation and the findings of the court
  5. Discussed a letter from Kansas Department of Transportation on a bridge at Caney
  6. Commissioner Lewark-Wood asked if there had been any response from the railroad. Mr. Bever said the crossing at Havana has been completed and the railroad is working on the one at Wayside.

SHERIFF:

 

Sheriff Stan Veach presented two (2) employee status changes for increases in salary.  Both were approved by the Board.

OTHER COUNTY BUSINESS:

 

  1. Acknowledged “thank you” note from Mrs. Bob Kline

 

  1. A letter from Sam Ford to Billie on damaged home

 

 

  1. Occupational License for My Place at Cherryvale –

ACTION:  A motion was made by Commissioner Fowler to approve the issuance of an Occupational License for My Place, Cherryvale, Kansas.  Motion was seconded by Commissioner Lewark-Wood.

  1. WIC agreement with Cherokee County –

ACTION:  A motion was made by Commissioner Fowler to approve the agreement between Montgomery County and Cherokee County Health Department WIC Program  to provide the facility for the program for scheduled days each month with schedule to be set for January 1, 2008 and ending December 31, 2008.  Motion was seconded by Commissioner Tucker.

RES. NO. 07-172

 

  1. Mr. Nelson Olinger was present at the meeting and presented some questions on the funding for the jail expansion.  He asked what would be the alternative if the sales tax question fails.  The answer was with a mill levy which would increase the county’s mill levy approximately 20 mills.

 

  1. Montgomery County Rural Fire -  Request to purchase truck from Cherryvale City –

Discussion:  Commissioner Lewark-Wood asked Montgomery County Rural Fire Coordinator Wilbur Schwatken to come to the meeting to discuss the truck available from Cherryvale City Fire Department previously requested by the Fire Board.  Mr. Schwatken told the Board he had checked with the Glenpool, Oklahoma Fire Chief and the truck they have available is a 1980 with engine problems and has been out of service for two (2) years.  They want $2,000.00 for the truck as is.

 

 The Fire Board requests purchasing the 1978 Pierce Pumper equipped without a hose and one nozzle from Cherryvale City for $6,500.00 for Liberty Fire Department.  The disposal of the Liberty truck was discussed and it will be put on e-bay and if not sold will be sold at the next county auction.  The following action was taken:

 

ACTION:  A motion was made by Commissioner Lewark-Wood to approve the purchase of a 1978 Pierce Pumper from Cherryvale City Fire Department at a cost of $6,500.00 to be debited from the Montgomery County Rural Fire Fund.  Motion was seconded by Commissioner Fowler.
