The Board of County Commissioners, three members and the County Clerk present, met in regular session at 9:00 AM.

CALL TO ORDER:  Commissioner Lewark-Wood.

INVOCATION:  Commissioner Tucker.

PLEDGE OF ALLEGIANCE:  Commissioner Fowler.

AGENDA APPROVAL:

 

ACTION A motion was made by Commissioner Tucker to approve the agenda as amended.  The motion was seconded by Commissioner Fowler.

     ROLL CALL VOTE – Commissioner Lewark-Wood - Yes

                                                   Commissioner Tucker - Yes

                                                   Commissioner Fowler – Yes

APPROVAL OF PAYMENT OF INVOICES:

 

ACTION:  A motion was made by Commissioner Fowler to approve invoices in the amount of ­$23, 039.50, $20,574.56 and $2,000.00 as presented by the County Clerk’s office.   The motion was seconded by Commissioner Tucker.

    ROLL CALL VOTE – Commissioner Lewark-Wood - Yes

                                                   Commissioner Tucker - Yes

                                                   Commissioner Fowler – Yes

EXECUTIVE SESSION – COUNTY COUNSELOR:

 

ACTION:  A motion was made by Commissioner Lewark-Wood to recess to Executive Session at 9:07 AM to return at 9:17 AM for Attorney/Client Privilege with Paul Kritz, County Counselor present.  Motion was seconded by Commissioner Tucker.

    ROLL CALL VOTE – Commissioner Lewark-Wood - Yes

                                                   Commissioner Tucker - Yes

                                                   Commissioner Fowler – Yes

 

Returned to session at 9:17 AM.

 

ACTION:  A motion was made by Commissioner Tucker to extend the executive session from 9:17 AM to 9:35 AM with County Counselor present.  Motion was seconded by

Commissioner Fowler.

    ROLL CALL VOTE – Commissioner Lewark-Wood - Yes

                                                   Commissioner Tucker - Yes

                                                   Commissioner Fowler – Yes

 

Returned to session at 9:35 AM with no action taken and no decisions made.

COUNTY BUDGET – 2008:

 

Larry Wright, CPA met with the Board to present the final figures for the 2008 County Budget.  The following action was taken:

 

ACTION:  A motion was made by Commissioner Lewark-Wood to approve the 2008 Montgomery County Budget for publication.  Motion was seconded by Commissioner Tucker.

    ROLL CALL VOTE – Commissioner Lewark-Wood - Yes

                                                   Commissioner Tucker - Yes

                                                   Commissioner Fowler – Yes

ACTION:  A motion was made by Commissioner Lewark-Wood to adopt a resolution for property taxes levied to finance the 2008 Montgomery County budget exceeding the amount levied to finance the 2007 Montgomery County Budget.  Motion was seconded by Commissioner Tucker.

    ROLL CALL VOTE – Commissioner Lewark-Wood - Yes

                                                   Commissioner Tucker - Yes

                                                   Commissioner Fowler – No

KANSAS DEPARTMENT OF TRANSPORTATION – WAYNE GUDMUNSON:

 

Wayne Gudmunson, Engineer for KDOT, met with the Board to give information on two upcoming projects in the county, overlay east on Highway 160 and overlay west of city limits of Coffeyville to Caney.

PUBLIC WORKS: 

 

Mr. Robert Bever, Public Works Coordinator, presented the weekly written report.  The following items were discussed:

  1. Request from David McMillin, Johnny Dodson and Vernon Conger to close County Road 5100 from County Road 1400 across Onion Creek and south to the Oklahoma State Line.  A date will be set for road viewing.
  2. Employee change of status for 90 day probation completion was approved.
  3. Dart Cherokee Oil Company is requesting right-of-way access on County Road 2300-24 on the west side.  Landowners will not give right-of-way (Springer and Schwatken).  Commissioner Fowler recommended a letter be sent to the landowners from Public Works.
  4. Bid opening for White goods debris removal as follows:

 

Global Pollution Services, Coffeyville, Kansas           34.25 unit pickup without salvage value

                                                                                          33.75 unit with salvage value

                                                                                          10.00 each for refrigerant evacuation

 

Littleton Storm & Timber, Jacksonville, IL                 58.00 unit pickup without salvage value

                                                                                          38.00 unit with salvage value

                                                                                          18.00 each for refrigerant evacuation

 

A decision will be made at the next meeting.

 

  1. Hiring of James Wright as Assistant Public Works Coordinator was approved and will begin employment July 30th.  The following action was taken:

ACTION:  A motion was made by Commissioner Tucker to approve the hiring of James Wright as Assistant Public Works Coordinator at a starting salary of $18.50 per hour with a 3.5% increase after 90 day probation to result in a wage of $39,832.00 per year.  Motion was seconded by Commissioner Fowler.

ENVIRONMENTAL HEALTH – SCOTT BARNHART:

 

Mr. Barnhart presented a request for the approval of the Board for the Resolution establishing an assistance Policy under circumstances where a private, commercial, or industrial source is deemed to pose a threat or risk to the pubic health and/or environment.  Removal of bio-hazardous materials will be the responsibility of the individuals.

 

ACTION:  A motion was made by Commissioner Lewark-Wood to adopt a resolution establishing an assistance Policy under circumstances where a private, commercial, or industrial source is deemed to pose a threat or risk to the pubic health and/or environment.

Motion was seconded by Commissioner Fowler.

COUNTY APPRAISER – REQUEST FOR SKETCH VECTOR:

 

Mr. Bob Kline, County Appraiser requested approval to purchase a sketch vector at a cost of approximately $2,500 to $3,000 with a yearly maintenance fee of $900.00.  Approval was given for Mr. Kline to obtain bids.

JUDGE CANADAY – CASH DRAWER:

 

A request was made to increase the change in the cash drawer of the Clerk of the District Court from $31.00 to $50.00.  The request was approved.

EXECUTIVE SESSION – LAND ACQUISITION:

 

ACTION:  A motion was made by Commissioner Tucker to recess to Executive Session at 11:25 AM to return at 11:55 AM with Jim Miller, Emergency Planning, Mickey Davis, Emergency Management Wyandotte County and Jackie Miller, Homeland Security present to discuss land acquisition.  Motion was seconded by Commissioner Lewark-Wood.

    ROLL CALL VOTE – Commissioner Lewark-Wood - Yes

                                                   Commissioner Tucker - Yes

                                                   Commissioner Fowler – Yes

Returned to session at 11:55 AM with no action taken and no decisions made.
