The Board of County Commissioners, three members and the County Clerk present, met in regular session at 9:00 AM.

APPROVAL OF PAYMENT OF INVOICES:
ACTION: A motion was made by Commissioner Tucker to approve invoices in the amount of $1,135.46 and $207,958.30 as presented by the County Clerks office. The motion was seconded by Commissioner Lewark-Wood.

911 TRUCK LINES INDEPENDENCE CHIEF OF POLICE:
Ken Parker, Independence Police Chief and Phillip Ryan representing AT&T met with the Board to request authorization to contract with AT&T for 911 truck lines for tandem trunking. Of the $11,500.00 cost, Cox Communication will pay a little over $2,800.00 of the cost then $343.00 per month and line will be owned by Cox and is priority.
Commissioner Tucker recommended Chief Parker take back to Cable 1, Cox, Sprint and other companies involved to see if they will submit an offer.
Roger Powell of the IPD said Cable One will not pay.
Chief Parker will request offers from the other companies and will return to the Board.

FEMA NATIONAL FLOOD INSURANCE PROGRAM:
Representatives of the National Flood Insurance Program presented information to the Board on the program. Congress set up the program for flood victims. Communities have to agree to manage flood areas. The counties must have a Flood Plain Resolution, which Montgomery County does have, and minimum standards within the flood plain. Standards include cannot build below chance of 100 year flood level and in Kansas it has to be one (1) foot higher than flood level.
They reported that Montgomery County has 213 policies under the National Flood Program and of the 213, 161 are in Zone A.
There must be a disaster declaration and no grants are available for people in flood are if not specified as a flood area.
Assessment team did not get all of the rural area assessed.

UNIFIED DISTRICT COURT REQUEST FOR COFFEYVILLE COMPUTER SERVER:
Judge Canaday met with the Board to request the purchase of a large capacity server for the Coffeyville District Court Office. Their server is out of service and a new one will cost approximately $6,200.00. He requested having the server installed and purchased through Advantage, Iola, Kansas. The following action was taken:
ACTION: A motion was made by Commissioner Tucker to approve the purchase and installation of computer equipment (server) in the Coffeyville District Court Office to be purchased from Advantage, Iola, Kansas at a cost of $6,200.00 and to be paid from County General Capital Outlay Fund. Motion was seconded by Commissioner Lewark-Wood.

MONTGOMERY COUNTY HEALTH AND MONTGOMERY COUNTY ENVIRONMENTAL HEALTH MOSQUITO PROBLEM AND FOOD ESTABLISHMENT PROBLEMS:
Addressed the mosquito problem in the flooded areas and throughout the county due to the excessive water. Inquired as to what extent the county is willing to assist citizens in mosquito related issues. A study will be made on the mosquito population and reported back to the Board.
Ruth Bardwell, Montgomery County Health Director and Scott Barnhart, Montgomery County Environmental Health Director, met with the Board on health problems occurring from the flooding in Coffeyville at three (3) restaurant and food locations. The doors are open and anyone can enter. The Board of County Commissioners serve as the Local Health Board and the two (2) health offices are requesting to hire contractor to clean up the establishments and it be added to the tax roll for the costs.
A letter will be sent to the establishments and they will be given a deadline for cleanup. Legal council will give an opinion on the letter before sent to the landowners. The following action was taken:
ACTION: A motion was made by Commissioner Tucker to authorize the County Health Department and Environmental Health Department Directors to notify restaurant and food locations in Coffeyville and be given a deadline for cleanup of their facilities. This authorization is pending upon the legal opinion of the County Counselor. Motion was seconded by Commissioner Lewark-Wood.

PUBLIC WORKS:
Robert Bever, Public Works Coordinator reported that 99% of roads have been accessed. Bridges and culverts are 50% complete but East 8th Street outside Coffeyville City limits is closed.
OTHER COUNTY BUSINESS:
ACTION: Motion by Commissioner Lewark-Wood and seconded by Commissioner Fowler that any employee who has the maximum carry-over for vacation time, the requirement to have this time taken will be waived due to employees working on flood issues.

ACTION: A motion was made by Commissioner Lewark-Wood to issue a proclamation of a State of Local Disaster Emergency for Montgomery County, Kansas on the 16th day of July by the authority vested in the Board by K.S.A. 1976 Supp. 48-932 stating that a State of Local Disaster Emergency exists in Montgomery County. Motion was seconded by Commissioner Tucker.

The Grievance Committee Report and recommendation was read by the Chairman. They recommended Mr. Brown be paid for all vacation and sick leave, when used, prior to his demotion on May 11, 2007 in his prior capacity as Supervisor. Further they recommended that he be paid the top available Equipment Operator III wage until retirement. The Committee consisted of Mr. Bob Wheeler, Mr. Jim Fricke and Mr. Dee Messer.
ACTION: A motion was made by Commissioner Tucker to accept the recommendation of the Grievance Committee as presented. Motion was seconded by Commissioner Fowler.

5. Road Complaint
Ann Greer, a resident of rural Elk City, had a complaint on CR 1700 and said the rain washes all gravel from the road very time it rains. Public Works will be advised of the complaint.
6. Commission meeting scheduled for Thursday, July 19th at 9:00 AM in the Commission Meeting Room.
