The Board of County Commissioners, three members and the County Clerk present, met in regular session at 9:00 AM.

CALL TO ORDER: Commissioner Lewark-Wood.

ACTION: A motion was made by Commissioner Tucker to approve the agenda as amended. The motion was seconded by Commissioner Fowler.

APPROVAL OF PAYMENT OF INVOICES:
ACTION: A motion was made by Commissioner Fowler to approve invoices in the amount of $196,429.91 and $35,966.69 as presented by the County Clerks office. The motion was seconded by Commissioner Lewark-Wood.

FLOOD REPORTING:
Chuck McGaha, Deputy Incident Commander under Jim Miller, spoke to the Commission. He advised the Kansas Assessment Team will be assessing buildings in Independence then rural and smaller areas He said the County Attorney needs to be involved but at the present time Larry Markle is ill. His home was also destroyed in the flood. Mr. McGaha said the County will be responsible for 15% of approved expenditures (approved by FEMA).
Scott Barnhart, Environmental Health Director, presented the Solid Waste Plan for this special need . It is necessary for the Board to adopt the Plan and a bulletin will be sent to each of the cities. The following action was taken:
ACTION: A motion was made by Commissioner Lewark-Wood to adopt the Solid Waste Plan as presented by Environmental Health for the disasters special needs. Motion was seconded by Commissioner Tucker.

Montgomery County Rural Fire Director Wilbur Schwatken requested approval to purchase a 40 lb extractor for the Rural Fire Department to extract contamination from fire gear. The unit will extract 2-3 sets of gear at one time and cost will be between $5500 and $6000. Mike Miller, Safety Office for the Incident Command team stressed how important the decontamination process is for the safety of the workers. The following action was taken:
ACTION: A motion was made by Commissioner Tucker to approve the purchase of a 40 lb extractor for the Montgomery County Rural Fire Department to extract contamination from fire gear at an estimated cost of $5,500 to $6,000 from Loomis Bros, Fenton Missouri. Motion was seconded by Commissioner Lewark-Wood.

Robert Bever, Public Works Coordinator, presented pictures from the road assessment team and reported two-thirds of the roads have been inspected and will be completed by Wednesday of this week.
Bridge No. 67 has been lost in the flood.
He feels there is need for four (4) extra trucks and one (1) extra blader.
Sheriff Veach and Ron Wade were presented. Gave a report on work being done by deputies and their staff.

LARRY WRIGHT NO FUND WARRANTS:
Larry Wright, CPA discussed the possible need for No Fund Warrants for the County due to the cost of the disaster. He said he hoped it could be handled like a line of credit and drawn only as needed with it being payable over a five (5) year period at the rate of 20% of the balance per year. He recommended Gilmore and Bell and has visited with Sara Steele, Attorney for Gilmore and Bell. The following action was taken:
ACTION: A motion was made by Commissioner Lewark-Wood to authorize Larry Wright to proceed with the process for applying for No Fund Warrants with a line of credit for $10,000,000 to be drawn on as needed. The need for the warrants is due to the flood disaster (Disaster #1711) in Montgomery County. Motion was seconded by Commissioner Tucker.

ACTION: A motion was made by Commissioner Lewark-Wood to adopt the Annual Management Weed Plan as presented by Public Works. Motion was seconded by Commissioner Tucker.

ACTION: A motion was made by Commissioner Lewark-Wood to issue a proclamation of a State of Local Disaster Emergency for Montgomery County, Kansas on the 9th day of July by the authority vested in the Board by K.S.A. 1976 Supp. 48-932 stating that a State of Local Disaster Emergency exists in Montgomery County. Motion was seconded by Commissioner Tucker.
