The Board of County Commissioners, three members and the County Clerk present, met in regular session at 9:00 AM.

CALL TO ORDER:  Commissioner Mattix.

INVOCATION:  Commissioner Mattix.  

PLEDGE OF ALLEGIANCE:  Commissioner Tucker.

 

AGENDA APPROVAL:

 

ACTION A motion was made by Commissioner Mattix to approve the agenda as amended.  The motion was seconded by Commissioner Lewark-Wood.

     ROLL CALL VOTE – Commissioner Mattix - Yes

                                                   Commissioner Tucker - Yes

                                                   Commissioner Lewark-Wood – Yes

APPROVAL OF PAYMENT OF INVOICES:

 

ACTION:  A motion was made by Commissioner Tucker to approve invoices in the amount of $18,164.23 as presented by the County Clerk’s office.   The motion was seconded by Commissioner Lewark-Wood.

ADVISORY BALLOT DISCUSSION:

 

Approximately 16 Montgomery County Citizens met with the Board to discuss the Advisory Ballot being presented to the voters. 

 

Commissioner Mattix read his concept comments.

 

Bob Pierce stated, “We need to change the way to do business and responsibility is to those who elected  the representatives of the County”.  He also stated they have a responsibility to the taxpayers.  He supports 5 member commission and one college, giving buildings sitting vacant  and to utilize what we have as his reasons.  Wants to also get the best out of our money.

 

Tony Fowler stated finances are not there to consolidate the colleges.  We will need more buildings, etc.  He said we receive funds from many sources and these would stop.  Feels too many boards would be problems.

 

Bob Pierce asked if Mr. Fowler has figures to back up figures and Mr. Fowler responded these boards have these figures.

 

Dan Small said he supports a vote by Advisory Ballot.

 

The question was asked, “Where would the one college be?”

 

Commissioner Tucker said he would not be in favor of closing either campus.  He asked, “Do taxpayers want to send a message to the college boards and the Board of Regents?”

 

ACTION:  A motion was made by Commissioner Mattix to proceed with an advisory election with two (2) questions on the ballot; Should Montgomery County have one Community College?; Should the Montgomery County Commission be composed of five members?. Election to be by mail ballot mailed approximately January 16th to be counted February 13th.   The motion was seconded by Commissioner Tucker.  Commissioner Tucker called for discussion and asked if the majority present was in favor of the advisory ballot.  Majority was by a show of hands.  The Chairman called for the vote.

RURAL WATER DISTRICT #6 – JOHN VANDYNE:

 

Mr. John VanDyne, Rural Water District #6 Board Member, met to discuss the charge the County adopted for use of aerial mapping information.

 

Mr. Robert Hobbs, Liberty City Treasurer was also present and advised the Board water is given to the Rural Fire District from the Rural Water District at no charge.  Commissioner Tucker stated all districts donate water to the Rural Fire District when needed.

 

Bob Kline, County Appraiser explained the time involved in separating one district out of the total map and pictures.  No decisions were made at this time.

COUNTY APPRAISER – EMPLOYEE STATUS CHANGES:

 

Mr. Bob Kline, County Appraiser, met with the Board to request approval for promotions for Susie Thompson and Robin VanDyne.  The Employee Status Changes were presented and approval was given by the Board.

PUBLIC WORKS:

 

Barbara Curtis, Public Works Coordinator, presented the weekly written report.  The following items were discussed:  City of Caney Drainage problem; Request for sandstone rock  to be purchased from the old McTaggart bridge site; Building Maintenance replacing piping on the 2nd floor scheduled  and is expected to take 2 to 3 days; and Household Hazardous Waste.  As a result of the report, no action was required.

EXECUTIVE SESSION – INTERVIEW FOR PUBLIC WORKS POSITION:

 

ACTION:  A motion was made by Commissioner Mattix to recess to Executive Session at 10:45 AM to return at 11:00 AM to discuss non-elected personnel.  Motion was seconded by Commissioner Lewark-Wood.

    ROLL CALL VOTE – Commissioner Mattix - Yes

                                                   Commissioner Tucker - Yes

                                                                 Commissioner Lewark-Wood – Yes

 

Returned to session at 11:00 AM with no action taken and no decisions made.

WILBUR SCHWATKEN – MONTGOMERY COUNTY RURAL FIRE CHRISTMAS DINNER:

 

Wilbur Schwatken, Rural Fire Director, met with the Board to request approval to have the Rural Fire Christmas Dinner catered due to Betty Hann having illness in her family.  The low bid for the catering services is K&B Drive In, Dearing in the amount of $1,500.00.  The following action was taken:

 

ACTION:  A motion was made by Commissioner Tucker to approve the request for the Montgomery County Rural Fire Christmas Dinner to be catered by K&B Drive In, Dearing, Kansas in the amount of $1,500.00.  Motion was seconded by Commissioner Lewark-Wood.

    ROLL CALL VOTE – Commissioner Mattix - Yes

                                                   Commissioner Tucker - Yes

                                                                 Commissioner Lewark-Wood – Yes

Mr. Schwatken advised the Board the Fire District has been awarded a grant in the amount of $244,600 with a 5% matching funds.  He requested approval to obtain bids for 132 sets of bunker gear.  The Board authorized Mr. Schwatken to obtain bids for the fire gear.

EXECUTIVE SESSION – COUNTY ATTORNEY & COUNTY COUNSELOR:

 

ACTION:  A motion was made by Commissioner Mattix to recess to Executive Session at 11:00 AM to return at 11:20 AM with County Attorney Larry Markle and County Counselor Paul Kritz present for attorney/client privilege.  Motion was seconded by Commissioner Lewark-Wood.

    ROLL CALL VOTE – Commissioner Mattix - Yes

                                                   Commissioner Tucker - Yes

                                                                 Commissioner Lewark-Wood – Yes

 

Returned to session at 11:14 AM with no action taken and no decisions made.

OTHER COUNTY BUSINESS:

                                                  

  1. Outstanding Check Resolution –

ACTION:  A motion was made by Commissioner Mattix to adopt the Outstanding Check Resolution as presented by the County Treasurer in the amount of $736.60 for checks two years or more outstanding.  Motion was seconded by Commissioner Lewark-Wood.

    ROLL CALL VOTE – Commissioner Mattix - Yes

                                                                 Commissioner Lewark-Wood – Yes

2.      Judge Canaday’s request for five (5) color inkjet printers, automatic staplers label maker and ink cartridges and recommended the purchase of the Toshiba Copier from Copy Products, Pittsburg, Kansas:

ACTION:  A motion was made by Commissioner Lewark-Wood to approve the purchase of five inkjet printers, seven automatic staplers and a label maker for Unified Court.  Total cost will be $976.81 to be paid from Capital Outlay Fund and to approve the recommendation of the purchase of the Toshiba Copier from Copy Products, Pittsburg, Kansas in the amount of $5,713.00.  Motion was seconded by Commissioner Mattix.
