October 19, 2006

 

The Board of County Commissioners, two members and the County Clerk present, met in evening session  at Dearing City at 7:00 PM.  Commissioner Tucker was absent.

CALL TO ORDER:  Commissioner Mattix.

INVOCATION:  Commissioner Mattix.      

PLEDGE OF ALLEGIANCE:  Commissioner Lewark-Wood.

 

AGENDA APPROVAL:

 

ACTION A motion was made by Commissioner Lewark-Wood to approve the agenda as amended.  The motion was seconded by Commissioner Lewark-Wood.

     ROLL CALL VOTE – Commissioner Mattix - Yes

Commissioner Mattix opened the meeting at the Dearing City Fire Station at 7:00 PM.  A list of attendees to the meeting is on file in the County Clerk’s office with the minutes.

DEARING CITY PROBLEM WITH 4-WHEELERS & MCRF#1:

 

Dearing City:

 

Randy Haymaker, Dearing City Mayor, requested the Board consider a resolution to ban 4-wheelers in the city limits or place certain restrictions on the usage of the vehicle.  The 4-wheelers are causing problems and especially after dark.  The Board will talk to the Sheriff and Paul Kritz to see what action can be passed to control the use and speed.  The issue will be discussed at the Monday regular meeting.

 

Mr. Haymaker discussed the accident in the front of their store on Hibbard St.  He asked if a double yellow line between the hills in front of Haymaker’s Furniture could be placed on the blacktop by the Public Works Department.  The Board will discuss this with Barbara Curtis.

 

Discussed the flooding from the creek going through Dearing and the erosion along the creek.  Scott Barnhart was present and advised the Board that a retaining wall would have a very small impact on the flooding problem.  Mr. Haymaker said they are seeking a CDBG Grant to help with the problem.

Montgomery County Rural Fire:

 

Mr. Haymaker, Montgomery County Rural Fire Board President, discussed the following issues with the Board regarding the Fire District:

  1. Sale of Surplus Merchandise – The by-laws of the Fire District are very vague on the sale of the merchandise.  Some of the merchandise is at individuals residences or places of business.  They discussed a place to store all the surplus items and where it could be located.
  2. Pump at Tyro – The pump at Tyro would not be relinquished to the Fire Coordinator and there is no authority provided in the present by-laws given to the Coordinator to force the issue. 
  3. The by-laws for the Rural Fire are reviewed and revised every 5 years.  Mr. Haymaker asked the Board to give the Fire Coordinator position to have the authority as County Fire Chief to have authority for issues such as the problem at Tyro regarding the pump.  No decisions were made at this time.
  4. The was discussion on the responses to Fire Departments being paged out and why some are responding when not needed and the extra expense to the county.  The problems in the dispatching process were discussed.  Jim Miller said some of the problems could be solved with the central dispatching and could possibly eliminate the extra responders without endangering the public.

 

ROBBINS CEMETERY DISTRICT – LAND ACQUISITION:

 

Mr. Bob Cowan, representing Robbins Cemetery District, met with the Board to discuss the possibility of the Montgomery County Counselor helping the Cemetery District with using “eminent domain” as provided in Kansas Statutes, to obtain adjoining land to the cemetery.  The Board agreed to allow Mr. Cowan to consult with the County Counselor for his guidance on proceeding with filing the eminent domain process.

OTHER COUNTY BUSINESS:

  1. Mr. Paul Ray Benson discussed his road problems which he has discussed before with the Board.  He stated he has been over 4 years trying to get work done.  The mail carrier confirmed the roads need crowning.  The Board will speak with Public Works.
  2. Mr. Billy Jones discussed the school in Dearing and how high the taxes are on the property.  He said the taxes are $16,00 and “no one can afford to own it”.
  3. The County Clerk requested approval for the JJA Director to purchase not to exceed $100.00 in refreshments for a meeting with State officials present.  The Board approved the request. 
  4. County Health Director, Ruth Bardwell requested, by letter, to be allowed to hire Barbara Hugo as a part-time temporary employee to administer flu vaccine at $15.00 per hour.  The following action was taken:

ACTION:  A motion was made by Commissioner Mattix to authorize the County Health Director to hire Barbara Hugo, RN as a part-time temporary employee to administer flu vaccine at a salary of $15.00 per hour.  Motion was seconded by Commissioner Lewark-Wood.
