The Board of County Commissioners, three members and the County Clerk present, met in regular session at 9:00 AM.

CALL TO ORDER: Commissioner Mattix.

ACTION: A motion was made by Commissioner Mattix to approve the agenda as amended. Motion was seconded by Commissioner Lewark-Wood.

APPROVAL OF PAYMENT OF INVOICES:
ACTION: A motion was made by Commissioner Mattix to approve invoices in the amount of $187,726.43 and $2,501.53 as presented by the County Clerk’s office. The motion was seconded by Commissioner Lewark-Wood.

JUVENILE JUSTICE AUTHORITY – AGENCY RENT:
Mr. Mark Charest, Children and Family Services Director, Juvenile Justice Authority, presented information on the increased rent rate for office space for his agency effective July 1, 2006 through June, 2007. The increased amount is $717.36 per month. Previously it was discussed with Duane Powell and the Board said the County will pay the difference between the old rate and the new rate. The following action was taken:
ACTION: A motion was made by Commissioner Mattix to subsidize the rent for the Children and Family Services office facilities in the amount of $717.36 per month as the county’s part of the fees effective July, 2006. Motion was seconded by Commissioner Lewark-Wood.

COUNTY TREASURER – EQUIPMENT PURCHASE:
Nancy Clubine, County Treasurer presented a request to purchase a color printer to print tax statements from Xerox at a cost of $1,799.00 with a one year warranty with a rebate of $200.00. The following action was taken:
ACTION: A motion was made by Commissioner Mattix to approve the purchase of a Xerox color printer for the County Treasurer’s office in the amount of $1,799.00 with $200.00 rebate. Debit County General Capital Outlay Fund. Motion was seconded by Commissioner Lewark-Wood.

PUBLIC WORKS:
Barbara Curtis met with the Board. She reported on the asphalt work in Woodland View and on Sunflower Bridge work. She also reported the new telephone system will completed this week and the new phones will be working next week.
EXECUTIVE SESSION:
ACTION: A motion was made by Commissioner Mattix to recess to Executive Session at 9:50 AM to return at 10:15 AM with Barbara Curtis present. Motion was seconded by
Commissioner Lewark-Wood.

MONTGOMERY COUNTY SHERIFF:
Sheriff Stan Veach met with the Board and expressed concern on the 2006 and 2007 budget for his department. He stated he did not feel he could stay with in budgets but especially the 2007 budget. He present comparisons for the past years of 2005, 2006 and the 2007 figures for personnel services, contractual services and commodities.
Commissioner Mattix told Sheriff Veach the Board is responsible for setting budgets and worked on all budgets. He also stated it will take whatever drastic measures have to be done to stay within the allowed budgets by the department heads. Sheriff Veach stated he cannot stay within the 2007 budget.
Commissioner Tucker and Commissioner Lewark-Wood said they will look at the budget again after the first of the year.
EXECUTIVE SESSION:
ACTION: A motion was made by Commissioner Mattox to recess to Executive Session at 10:45 AM to return at 10:50 AM with the Sheriff present to discuss non-elected personnel. Motion was seconded by Commissioner Lewark-Wood.

Returned to session at 10:50 AM with no action taken and no decisions made.
ACTION: A motion was made by Commissioner Mattix to return to Executive Session at 10:58 AM to return at 11:05 AM with the Sheriff and County Attorney present to discuss non-elected personnel. Motion was seconded by Commissioner Lewark-Wood.

SENIOR SERVICES – NORMA FOSTER:
Norma Foster , Chairperson for Senior Services presented the proposed 2007 recommended budgets for all Senior Service facilities in the total amount of $144,522.00. A copy of the minutes of the August 23, 2006 Montgomery County Senior Services Advisory Board was presented by Ms. Foster.
Commissioner Mattix acknowledged receipt of the report and thanked Ms. Foster for her work with this group.

COUNTY CLERK – EXECUTIVE SESSION:
ACTION: A motion was made by Commissioner Mattix to recess to Executive Session at 11:06 AM to return at 11:20 AM to discuss non-elected personnel with the County Clerk, Human Resources Director, County Health Director, DOC Administrator and Sheriff present. Motion was seconded by Commissioner Tucker.

Returned to session at 11:20 AM with no action taken and no decisions made.
Discussion: The additional 7.5 hours approved in the meeting of September 11th for Mary Ann Freedle will make the total hours 37.5 hours with 30 for County Health and 7.5 for DOC. The Board agreed this will be two (2) part-time positions and not one (1) full time position.

OTHER COUNTY BUSINESS:
ACTION: A motion was made by Commissioner Mattix to approve the Occupational License for Coffeyville Eagles Club. Motion was seconded by Commissioner Lewark-Wood.

ACTION: A motion was made by Commissioner Mattix to adopt a resolution establishing certain standards for private burying grounds in Montgomery County, Kansas. Motion was seconded by Commissioner Lewark-Wood.
