The Board of County Commissioners, three members and the County Clerk present, met in regular session at 9:00 AM.

CALL TO ORDER:  Commissioner Mattix.

INVOCATION:  Commissioner Tucker.

PLEDGE OF ALLEGIANCE:  Commissioner Lewark-Wood.

Recessed to Road Viewing site at CR 5700 North of CR 6000 at 9:05 AM.

ROAD VIEWING:

 

Meeting reconvened at 9:30 AM for road viewing.  Chairman Mattix conducted the viewing at CR 5700 North of 6000.  Legal description as follows:  A portion of Road 166 (5700-25), as described in Road Record Book 1, Page 103 in the Montgomery County Public Works Office located in Section 16, Township 31 South, Range 17 East of the 6th Principal Meridian in Montgomery County, Kansas, beginning approximately 1,600 feet north of the southeast corner of Section 16 County Road 6000-23); thence north approximately 800 feet to the south right-of-line Highway 400 and having a right-of-way of 60 feet.

 

Public attending the viewing were:  Kenny March, A. Glenn Thornton, Raymond L. Shivers, Jean March, Esta Wagner, Daniel Jones, Nanette Jones, Vinita Thornton, Charles D. Elsworth, Clifford Plummer, Carolyn Stillwell and Neva Plummer.  County representatives attending the viewing were Public Works Supervisor Vasco Brown, Public Works Coordinator Barbara Curtis, Board of County Commissioners and County Clerk Charlotte Schmidt.

 

All 12 individuals attending the public meeting listed above were in opposition to the closing of the road.  After discussion the following action was taken:

 

ACTION:  A motion was made by Commissioner Lewark-Wood to leave the road as is and deny the closing of the following described road:  A portion of Road 166 (5700-25), as described in Road Record Book 1, Page 103 in the Montgomery County Public Works Office located in Section 16, Township 31 South, Range 17 East of the 6th Principal Meridian in Montgomery County, Kansas, beginning approximately 1,600 feet north of the southeast corner of Section 16 County Road 6000-23); thence north approximately 800 feet to the south right-of-line Highway 400 and having a right-of-way of 60 feet.  Motion was seconded by Commissioner Tucker.

ROAD VIEWING:

 

Board of County Commissioners, County Clerk, Public Works Coordinator Barbara Curtis, Public Works Supervisor Vasco Brown, Bryan Eytcheson and Tammy Grimes met at the viewing site.  There were no objections to request for the road closing.  The following action was taken:

 

ACTION:  A motion was made by Commissioner Mattix to approve the request to close the following described road:  A portion of Queens Lane located in the Northwest quarter of the Northeast quarter of section 7, Township 32 South, Range 16 east of the 6th Principal Meridian, in the River View Sub-Division as recorded in the Montgomery County Register of Deeds Office, Book B, Page 55A, more particularly described as follows:

 

Beginning a the Southeast corner of Lot 18, thence West 441 feet; thence South 60 feet; thence East 441 feet; thence North 60 feet; to the point of beginning having a 60 foot right-of-way.  Motion was seconded by Commissioner Lewark-Wood.

APPROVAL OF MINUTES:

 

ACTIONA motion was made by Commissioner Lewark-Wood to approve the minutes of August 3, 7 and 14, 2006 as presented by the County Clerk . The motion was seconded by Commissioner Mattix.

APPROVAL OF PAYMENT OF INVOICES:

 

ACTION:  A motion was made by Commissioner Lewark-Wood to approve invoices in the amount of $349,048.68 and $10,500.00 as presented by the County Clerk’s office.   The motion was seconded by Commissioner Mattix.

PUBLIC WORKS:

 

Barbara Curtis, Public Works Coordinator, presented the weekly written report.  The following items were discussed:  Chip and seal program; Bids for interest rates for Motorgraders; awarding of bid for motorgraders; Major Bridge Replacement Status; and Building Maintenance (Antennas on the Judicial Center roof have been identified.  Removal of antennas not in use is underway and grounding of the remaining ones will be scheduled).  As a result of this report, the following actions were taken: 

 

ACTION:  A motion was made by Commissioner Mattix to authorize the Public Works Coordinator to accept the bid from Martin Tractor for three (3) motor graders (2 new graders and 1 used grader) in the amount of $381,964.00.  Debit Sp. Rd. Br. St. Bldg Mach Equipment Fund.  Motion was seconded by Commissioner Lewark-Wood.

Interest Rates for Motorgraders –

 

Commercial Bank – 5.48%

Commerce Bank – 4.662%

Community National Bank – 4.60%

Community State Bank – 4.85%

 

Rates were referred to the Public Works Coordinator for recommendation.

 

Ms. Curtis requested approval for temporary hiring before hiring full time and contract through a “temp” agency.  She will return to the Board next week with more information.

MONTGOMERY COUNTY SHERIFF – AGREEMENT COUNTY/CITY OF CHERRYVALE:

 

Sheriff Stan Veach presented a written agreement between the Montgomery County Sheriff’s office and the City of Cherryvale to furnish off duty deputies to patrol the City of Cherryvale.  The agreement was signed by the Montgomery County Sheriff, Acting Chief of Police for Cherryvale City and  Commissioner Lee Mattix, Chairman of the Board.  The Board acknowledged receipt of the signed agreement.

MONTGOMERY COUNTY TREASURER – EXECUTIVE SESSION:

 

ACTION:  A motion was made by Commissioner Lewark-Wood to recess to Executive Session at 11:10 AM to return at 11:30 AM with the County Treasurer present to discuss non-elected personnel.  Motion was seconded by Commissioner Mattix.

Returned from Executive Session at 11:20 AM with no action taken and no decisions made.

 

Discussed a request by the County Treasurer for shared leave for an employee for 80 hours.  The following action was taken:

 

ACTION:  A motion was made by Commissioner Lewark-Wood to approve shared leave for 80 hours in the County Treasurer’s Department.  Motion was seconded by Commissioner Mattix.

COUNTY APPRAISER – EQUIPMENT PURCHASE:

 

ACTION:  A motion was made by Commissioner Mattix to authorize the County Appraiser to purchase a Dell  computer printer for the Appraiser’s office in the amount of $1,703.38.  Debit County General Capital Outlay Fund.  Motion was seconded by Commissioner Lewark-Wood.

OTHER COUNTY BUSINESS:

 

  1. Discussion on “Burial on Private Land” –

The County Clerk asked for approval to obtain the services of the County Counselor to set guidelines for “Burial on Private Land” and return to the Board with the recommended guidelines.  Approval was given.

 

  1. Emergency Preparedness Director Jim Miller advised there will be a program given at the September 25th Department Luncheon on Pandamic Flu.
  2. Mileage will be set at 43 cents as per the State allowance effective July 1st, 2006.
  3. Grant Writing Workshop –

Mr. Jim Miller was given approval to attend a three (3) day workshop in Chanute sponsored by RC&D with an enrollment fee of $475.00.
