APPROVAL OF MINUTES:
ACTION: A motion was made by Commissioner Lewark-Wood to approve the minutes of January 9, 2006 as presented by the County Clerk. The motion was seconded by Commissioner Mattix.

UNIFIED COURT – JUDGE CANADAY:
Judge Canaday and Mary Kadel met with the Board to discuss computer equipment in the amount of $6,800.00 for Court Services. The equipment had previously been committed by Judge Dent for Court Services and also for rental of computer equipment for Unified Court. After discussing budget for 2005 and 2006, the following action was taken:
ACTION: A motion was made by Commissioner Mattix to approve expenditures to be debited for computer equipment for Court Services and payment for rental of computer equipment for Unified Court to be debited as follows: $2349.00 – Capital Outlay (2005 Budget); $10,181.00 – County General Capital Outlay (2006 Budget). Motion was seconded by Commissioner Lewark-Wood.

APPOINTMENT OF DEPARTMENT HEADS AND HOLIDAY SCHEDULE:
The annual schedule of appointed was discussed and the 2006 Holiday Schedule. The following action was taken:
ACTION: A motion was made by Commissioner Mattix to appoint the following Department Administrators for the year 2006 due to commendable performance and maintaining momentum and function in their positions, motion seconded by Commissioner Tucker:

COMMISSIONERS “STATE OF THE COUNTY STATEMENT BY THE CHAIRMAN:
Commissioner Mattix presented The State of Montgomery County, Kansas as Observed by the County Commissioners. A copy of the presentation is made a part of these minutes in its entirety.
JUVENILE JUSTICE AUTHORITY – DUANE POWELL – CORE PROGRAM:
Duane Powell, Juvenile Justice Authority Director, presented the agreement for the CORE Program for JJA for the signature of the Chairman. Mr. Powell also discussed the Girard Facility and asked if there is a copy of a contract between Montgomery County and Girard. The County Clerk will check files for a contract but is not aware of one on file.

COMMUNITY CORRECTIONS – COMPUTER BIDS:
Kurtis Simmons, Community Corrections Director, presented bids for four (4) computer work stations as follows:
Computer Generation, Independence, Kansas $5,596.00
Advantage Computer Enterprises, Inc., Iola, Kansas $7,217.00
ACTION: A motion was made by Commissioner Lewark-Wood to approve the purchase of four (4) computer stations for Community Corrections Department from Computer Generation, Independence, Kansas with the low bid of $5,596.00. Debit Community Corrections Department. Motion was seconded by Commissioner Tucker.

PUBLIC WORKS:
Barbara Curtis, Public Works Coordinator, presented the weekly written report. The following items wre discussed: Road and Bridge Work (working on Card Creek Road), award of 12” Pipe, Requested permission to purchase two (2) 10 ton air assisted hydraulic floor jacks; Building Maintenance Pest Control Bids. Other items discussed were:
As a result of the report and discussion, the following actions were taken:
ACTION: A motion was made by Commissioner Lewark-Wood to award the bid for corrugated metal pipe to J & J Metals, Paola, Kansas in the amount of $5,112.00. Debit Road and Bridge Fund. Motion was seconded by Commissioner Tucker.

ACTION: A motion was made by Commissioner Mattix to approve the low bid of $1,650.00 for Pest Control for the Courthouse and Judicial Building and award the bid to CPR/State Termite Control Co., Independence, Kansas. Debit Building Maintenance. Motion was seconded by Commissioner Lewark-Wood.

Linda Boots & Art Gritton met with the Board and the Public Works Director to discuss the possibility of purchasing a lot adjoining the Wayside Christian Church and is presently owned by the county. There being no reason the county would have need of the lot, the following action was taken:
ACTION: A motion was made by Commissioner Mattix to sell the county owned lot adjoining the Wayside Christian Church for the sum of $7.00 to the Wayside Christian Church. The County Clerk was directed to prepare a Quitclaim Deed from the County to Wayside Christian Church. Motion was seconded by Commissioner Tucker.

EXECUTIVE SESSION:
ACTION: A motion was made by Commissioner Mattix to recess to Executive Session at 10:40 AM to return at 11:10 AM for Attorney/Client Privilege with Paul Kritz, County Counselor, Board of County Commissioners, County Clerk, County Appraiser, Jim Shontz and Kathy Craig present. Motion was seconded by Commissioner Lewark-Wood.

OTHER COUNTY BUSINESS:
ACTION: A motion was made by Commissioner Mattix to authorize the County Clerk to increase the Personal Services line item for the Department of Corrections on the 2006 budget by $31,200.00 for the salary of the Jail Nurse and increase the County Clerk’s line item by $20,800.00 for the Payroll Clerk. The Jail Nurse is a new position and the Payroll Clerk’s salary was omitted from the 2005 budget. Debit County General Operating Fund. Motion was seconded by Commissioner Lewark-Wood.

ACTION: A motion was made by Commissioner Mattix to approve payment of Kansas Association of Counties dues for 2006. Motion died for lack of a second.
ACTION: A motion was made by Commissioner Lewark-Wood to approve abatements in the amount of $43,558.28 as presented by the County Clerk’s Office. Motion was seconded by Commissioner Tucker.

OTHER BUSINESS (Continued):
ACTION: A motion was made by Commissioner Mattix to increase the mileage rate for Montgomery County to 40 cents per mile and each year hereafter will be changed automatically as the State of Kansas rate changes. Motion was seconded by Commissioner Lewark-Wood.

6. Verbal approval was given to payroll department to pay Sheriff’s payroll with signatures of the Commissioners.
Ken Collins met with the Board and advised the purchase of the camera will be approximately $300.00. He also advised the update for the website will be less than $1,000.00. The following action was taken:
ACTION: A motion was made by Commissioner Mattix to authorize the Computer Department authority to update the website but not to exceed $1,000.00 for equipment, vendors and consultants. Motion was seconded by Commissioner Tucker.
