The Board of County Commissioners, two members and the County Clerk present, met in regular session at 9:00 AM. Commissioner Tucker was absent due to illness.

CALL TO ORDER: Commissioner Mattix.
INVOCATION: Commissioner Mattix.

ACTION: A motion was made by Commissioner Mattix to approve the agenda as amended. The motion was seconded by Commissioner Lewark-Wood.

APPROVAL OF PAYMENT OF INVOICES:
ACTION: A motion was made by Commissioner Mattix to approve invoices in the amount of $411,220.62 as presented by the County Clerk’s office. The motion was seconded by Commissioner Lewark-Wood.

TRUCK WEIGHT LIMITS – DAVID McMILLEN:
Mr. David McMillen, Montgomery County resident and local farmer, addressed the Board with concerns over the “truck weight limit signs” recently posted on designated roads within the county. Mr. McMillen said he also represents SEK Grain, Liberty, Kansas and the 27 ton limit he feels could cause a problem to the farmers trucking grain to and from farms and the grain elevator.
The Board explained the restriction is on “through” traffic and does not affect the transportation of grain or farm products by the farmers. The resolution was not put in place to hinder the agricultural industry within the county but to end through traffic trucks using county roads instead of the highways.
Mr. McMillen stated he would rather pay higher taxes and not have a load limit placed on the roads. No action was taken.

PUBLIC WORKS:
Barbara Curtis, Public Works Coordinator, presented the weekly written report. The following items were discussed: Bid opening for tractor and mowers scheduled; Gravel hauling and tree and brush cutting; Building Maintenance (non-skid surface on courthouse steps and ramp at Judicial Center); and consider request for closing Road 1600.
A request has been made by Mr. Charles Roberts to close County Road 1600. Mr. David Deal owns property on one side and Mr. Roberts on the other side. This is the second request to close this road. The Deal’s oppose the closing of the road. Commissioner Mattix said “leave as is”. Commissioner Lewark-Wood said Mr. Roberts had contacted her at home. Mr. Roberts will be invited to attend a commission meeting if he so desires. No action was taken.
Bids for one (1) tractor and three (3) mowers as follows:

ACTION: A motion was made by Commissioner Mattix to accept the bid for one (1) 2006 John Deere Tractor, O’Malley Equipment, Independence, Kansas in the amount of $36,400.00 and three (3) 2006 Brush Hog Mowers from Shepherd Truck & Tractor, Independence, Kansas in the amount of $24,513.00 total. Debit Road and Bridge Fund $16,342.00; Noxious Weed Fund $36,400.00 and Noxious Weed Capital Outlay Fund $8,171.00. Motion was seconded by Commissioner Lewark-Wood.

COUNTY HEALTH AND DEPARTMENT OF CORRECTIONS:
Ruth Bardwell, County Health Director, met with the Board with a recommendation for hiring of employee as Jail Nurse in the Department of Corrections as previously discussed and approved by the Board.
Ms. Bardwell requested approval to hire Robert Wullenschneider to begin work on Wednesday December 21st at a salary of $15.00 per hour as a full-time, 40 hour per week employee with benefits. The following action was taken:
ACTION: A motion was made by Commissioner Mattix to approve the hiring of
Robert Wullenschneider in the Department of Corrections as Jail Nurse at a salary of $15.00 per hours, full-time, 40 hours per week with benefits to begin employment December 21st, 2005. Motion was seconded by Commissioner Lewark-Wood. Salary will be paid from Department of Corrections budget.

Ms. Bardwell reported on the Amazon.com employee illness problem which happened recently after an employee dinner. She advised it will be two to three weeks before results are back from the KDHE on what caused the illness and what food could have been the cause.

JAIL COMMITTEE MEETING WITH BOARD OF COUNTY COMMISSIONERS:
The Jail Committee met with the Board of County Commissioner and Commissioner Mattix issued a written background and directives to the Committee. The Committee then met to organize and determine a secretary and vice-chairman. Judge Lively is chairman of the committee but was unable to attend the meeting. The next Jail Committee meeting will be January 4th in the Judicial Building.

MONTGOMERY COUNTY SHERIFF:
Sheriff Veach discussed the fingerprinting expenses connected with the fingerprint machine. The Board agreed to pay expenses for supplies and maintenance from the General Operating Fund and the Sheriff will submit the bills to the County Clerk marked “fingerprinting expenses” to be paid. They will then be submitted to the Board for their signatures. Revenue from fingerprinting is deposited to the General Operating Fund as per Kansas Statute.

OTHER COUNTY BUSINESS:
ACTION: A motion was made by Commissioner Lewark-Wood to approve the issuance of an Occupational License for Coffeyville Country Club, Coffeyville, Kansas. Motion was seconded by Commissioner Mattix.

Verbal approval was given to issue payroll checks prior to signature of County Commissioners for ending December payrolls.
ACTION: A motion was made by Commissioner Mattix to recess to Executive Session at
10:27 AM to return at 10:37 AM to discuss non-elected personnel. Motion was seconded by Commissioner Lewark-Wood.

Returned from Executive Session at 10:37 AM with no action taken and no decisions made.
ACTION: A motion was made by Commissioner Mattix to amend Montgomery County Resolution 05-241 to read: “subject to approval and receipt of grants and low interest loans”. Motion was seconded by Commissioner Lewark-Wood.
