The Board of County Commissioners, three members and the County Clerk present, met in regular session at 9:00 AM.

CALL TO ORDER:  Commissioner Mattix.

INVOCATION:  Commissioner Mattix.  

PLEDGE OF ALLEGIANCE:  Commissioner Lewark-Wood.

 

AGENDA APPROVAL:

 

ACTION A motion was made by Commissioner Lewark-Wood to approve the agenda as amended.  The motion was seconded by Commissioner Mattix.

     ROLL CALL VOTE – Commissioner Mattix - Yes

                                                   Commissioner Tucker - Yes

                                                   Commissioner Lewark-Wood – Yes

APPROVAL OF MINUTES:

 

ACTIONA motion was made by Commissioner Lewark-Wood to approve the minutes of June 2, June 27, July 7 and July 11, 2005 as presented by the County Clerk.  The motion was seconded by  Commissioner Tucker.

    ROLL CALL VOTE – Commissioner Mattix - Yes

APPROVAL OF PAYMENT OF INVOICES:

 

ACTION:  A motion was made by Commissioner Tucker to approve invoices in the amount of $236,039.85 as presented by the County Clerk’s office.   The motion was seconded by Commissioner Mattix.

    ROLL CALL VOTE – Commissioner Mattix - Yes

                                                   Commissioner Tucker - Yes

                                                   Commissioner Lewark-Wood – Yes

JUDGE RAWLEY DENT – 2006 BUDGET PROPOSED EXPENSES:

 

Judge Dent met shortly with the Board to express his concern if the Board lowers the 2006 budget for Unified Court, Sheriff or County Attorney.  His concerns focused on case expenses, expenses paid to Road and Bridge and others his office faces in the next year.  No action or decisions were made at this time.  He will meet at a later date with the Board to discuss ideas for the jail expansion.

COUNTY BUDGET SESSION:

 

The Board of County Commissioners, Larry Wright and the County Clerk worked on the 2006 Montgomery County Budget.  Each budget was reviewed and decisions in order to bring the tax levy into line with the present levy.  A new draft of the budget will be supplied showing each change made to the previous draft and will be discussed at the budget session on Thursday, July 21st at 9:00 AM.

 

OTHER COUNTY BUSINESS:

  1. Purchases by Department of Corrections –

A note from Sheriff Stan Veach stated the Department of Corrections Administrator had ordered 25 mattresses at $115.00 each; 25 mattresses at $135.00 each and 50 beds at $400.00 each without official approval from the Board of County Commissioners.  Mr. Booth had addressed the need for more beds at a previous meeting but no official action was taken.  The total cost for the items is $26,250.00.  There was discussion on the department or fund that will pay for the purchases.  The following action was taken:

ACTION:  A motion was made by Commissioner Lewark-Wood to approve the purchase of 50 mattresses and 50 beds for the Department of Corrections at a total cost of $26,250.00 to be debited from the Department of Corrections Budget.  Motion was seconded by Commissioner Tucker.

  1. State of Kansas Mileage Rate Change –

Acknowledged letter but no change to the present county rate of 36 cents.

 

  1. Refinery Sale –

Commissioner Lewark-Wood presented information she had obtained to the Board on finances of the refinery.  Paul Kritz, County Counselor’s letter was acknowledged requesting he attend an “oral argument on a question on the Farmland Industries claim October 17th, 2005 with Attorney Terry Cupps who will be presenting the argument on behalf of the County.  The following action was taken:

 

ACTION:  A motion was made by Commissioner Mattix to approve the request of the County Counselor to attend an “oral argument on a question on the Farmland Industries claim October 17th, 2005 with Attorney Terry Cupps who will be presenting the argument on behalf of the County

  1. Montgomery County Bid Policy and Procedure –

 

ACTION:  A motion was made by Commissioner Mattix to approve the revised Montgomery County Bid Policy and Procedure as presented, at the Board’s request, by the County Clerk.  Motion was seconded by Commissioner Tucker.

    ROLL CALL VOTE – Commissioner Mattix - Yes

                                                   Commissioner Tucker - Yes

                                                   Commissioner Lewark-Wood – Yes

RES. NO. 05-149

  1. Executive Session –

 

ACTION:  A motion was made by Commissioner Tucker to recess to Executive Session at 1:06 PM to return at 1:11 PM to discuss non-elected personnel with the Board present.  Motion was seconded by Commissioner Mattix.

    ROLL CALL VOTE – Commissioner Mattix - Yes

                                                   Commissioner Tucker - Yes

                                                   Commissioner Lewark-Wood – Yes

 

Returned to session at 1:11 PM with no action taken and no decisions made.
