The Board of County Commissioners, three members and the County Clerk present, met in continued regular session of April 11, 2005 at 10:00 AM.

CALL TO ORDER: Commissioner Mattix.
INVOCATION: Commissioner Tucker.

MONTGOMERY COUNTY HEALTH DEPARTMENT NON-ELECTED PERSONNEL:
Ruth Bardwell, Montgomery County Health Director, met with the Board and requested an Executive Session for non-elected personnel.
ACTION: A motion was made by Commissioner Mattix to recess to Executive Session at 10:05 AM to return at 10:15 AM with Ruth Bardwell present to discuss non-elected personnel. Motion was seconded by Commissioner Tucker.

Returned to session at 10:15 AM with no action taken and no decisions made.
Ms. Bardwell presented a request to increase the salary of the custodian for their building from $225.00 per month to $250.00 per month. The following action was taken:
ACTION: A motion was made by Commissioner Lewark-Wood to approve the increase of the custodian position for County Health from $225.00 per month to $250.00 per month. Motion was seconded by Commissioner Mattix.

A new salary range for County Health employees was presented by Ms. Bardwell. The Board will take this under advisement until April 25th.

HUMAN RESOURCES-PUBLIC AWARENESS WEEK & DISPOSAL OF COUNTY RECORDS:
Liz Schwatken, Human Resources Director, presented information on shredding of records and disposal of these records. Quotes were obtained and CLASS submitted the low quote. When discussing the services with Phillip Chappuie at CLASS, he stated they would not assume the liability once it left the courthouse in case of identity theft. Shredd It Company, Wichita, Kansas quoted $350.00 based on the estimated amount of materials to be shredded, it would be shredded on site at the courthouse and they would assume liability once it left the courthouse. The following action was taken:
ACTION: A motion was made by Commissioner Lewark-Wood to contract with Shredd It, Wichita, Kansas for disposal of records and materials for the County at an estimated cost of $350.00 per year, to be shredded on site and liability to assumed by Shredd It Company. The motion was seconded by Commissioner Tucker.

HUMAN RESOURCES (Continued):
Public Awareness Week:
Ms. Schwatken presented a request to the Board to observe Public Awareness Week for County employees. This would be observed with posters and certificates for employees. The following action was taken:
ACTION: A motion was made by Commissioner Mattix to authorize the Human Resources Director to spend up to $300.00 honoring County employees during Public Awareness Week . Motion was seconded by Commissioner Lewark-Wood.

WESTAR MEETING MOVING OF POWER LINES DURING BRIDGE REPLACEMENT:
Those present for the meeting were: Westar Representatives Vic Gorman, Bob St. John, and Dave Gorman. Those representing the county were Barbara Curtis, Vasco Brown and Mark Eccles. Mr. Kenny Blair represented Cook, Flatt and Stroble Engineering.
Mr. Blair began the meeting by addressing the high voltage power lines and being difficult to design around. These lines will have to be moved for the replacement of the bridge on Sunflower Road north of Coffeyville. Mr. Blair stated that KDOT has criteria that has to be met when relocating the lines. There are a total of 7 poles to be moved, 6 being on private easement and 1 on county right-of-way.
Mr. Dave Gorman addressed the fact of only one pole being on county right-of-way and when these poles are relocated, they must be in a straight line due to tension on the pole. He discussed the angle and placement of the poles being relocated. He also stated it will take 90 days to complete the move.
The estimated cost will be $120,000 with the county portion of this cost being $100,000. Westar will stand the cost of relocating one pole.
Commissioner Mattix asked about why the County is paying 83% of the cost.
Mr. St. John said the cost is based on the poles and what right-of-way will cost.
The Board will write a letter to Westar to be addressed to Mr. St. John to propose a 50/50 split in cost between the county and Westar.

1. Auctioneer Bid
ACTION: A motion was made by Commissioner Mattix to approve the low auctioneer bid from Jim Buchanan for the Montgomery County auction to be held May 7th at a rate of 2.568%. Advertising is to be paid by the County. Motion was seconded by Commissioner Tucker.

Commissioner Mattix presented a letter addressed to Mr. Steve Coltharp stating the Board of County Commissioners has decided to not appoint you as Emergency Preparedness Director. His last day will be April 25, 2005.

3. Amendment to Employee Handbook
ACTION: A motion was made by Commissioner Lewark-Wood to amend the Sick Leave section of the Montgomery County Employee Handbook as follows: Upon retirement or termination of employment, after one (1) year of service, an employee will be paid 33 1/3% of any unused sick leave days up to a maximum of 100 days or 33 1/3 calendar days.
Sick leave benefits are solely to provide income protection in the event of illness or injury and may not be used for any other absence. Unused sick leave benefits will not be paid to employees while they are employed or upon termination of employment of less than one (1) year of service.
Motion was seconded by Commissioner Tucker.
