The Board of County Commissioners, three members and the County Clerk present, met in regular session at 7:00 P.M.

CALL TO ORDER:  Commissioner Mattix.

INVOCATION:  Commissioner Tucker.

PLEDGE OF ALLEGIANCE:  Boy Scout Troop 4 – Justin Eubanks, J.C. Ellis and Tyler Strange.

 

AGENDA APPROVAL:

 

ACTION A motion was made by Commissioner Lewark-Wood to approve the agenda as amended.  The motion was seconded by Commissioner Tucker.

     ROLL CALL VOTE – Commissioner Mattix - Yes

                                                   Commissioner Tucker - Yes

                                                   Commissioner Lewark-Wood – Yes

APPROVAL OF PAYMENT OF INVOICES:

 

ACTION:  A motion was made by Commissioner Tucker to approve invoices in the amount of $183,088.71 and $10,514.00 as presented by the County Clerk’s office.   The motion was seconded by Commissioner Lewark-Wood.

MONTGOMERY COUNTY RURAL FIRE DST. #1 – MASTER FIRE PLAN DISCUSSION:

 

Wilbur Schwatken, Montgomery County Rural Fire Director, appeared before the Board at the request of Commissioner Mattix, to discuss the Master Fire Plan for Montgomery County.  The following action was taken:

 

ACTION:  A motion was made by Commissioner Mattix to authorize the Montgomery County Rural Fire Director to pursue a master fire plan for Montgomery County.  Motion was seconded by Commissioner Tucker.

    ROLL CALL VOTE – Commissioner Mattix - Yes

                                                   Commissioner Tucker - Yes

                                                   Commissioner Lewark-Wood – Yes

OIL AND GAS INCOME – NELSON OLINGER:

 

Mr. Nelson Olinger was added to the agenda to discuss what income the county has from oil and gas activity within the county.  He also addressed the damage to county roads by the oil and gas producers equipment and this cost to the county.

EXECUTIVE SESSION:

 

ACTION:  A motion was made by Commissioner Mattix to recess to Executive Session at

7:40 PM to return at 8:00 PM with Wilbur Schwatken present to discuss non-elected personnel.  Motion was seconded by Commissioner Lewark-Wood.

ROLL CALL VOTE – Commissioner Mattix - Yes

                                               Commissioner Tucker - Yes

                                               Commissioner Lewark-Wood – Yes

 

 

Returned to session at 8:00 PM with no action taken and no decisions made.

EXECUTIVE SESSION:

 

ACTION:  A motion was made by Commissioner Mattix to recess to Executive Session at 8:00 PM to discuss non-elected personnel with the Board present to return at 8:15 PM.  Motion was seconded by Commissioner Tucker.

                                               Commissioner Tucker - Yes

                                               Commissioner Lewark-Wood – Yes

 

 

Returned to session at 8:15 PM with no action taken and no decisions made.

ACTION:  A motion was made by Commissioner Mattix to recess to Executive Session at 8:20 PM to return at 8:40 PM with Scott Barnhart present to discuss non-elected personnel.  Motion was seconded by Commissioner Lewark-Wood.

                                               Commissioner Tucker - Yes

                                               Commissioner Lewark-Wood – Yes

 

 

Returned to session at 8:40 PM with no action taken and no decisions made.

OTHER COUNTY BUSINESS:

 

  1. Amend Resolution 04-89 and 05-54 regarding abatements for American Insulated Wire:

 

ACTION:  A motion was made by Commissioner Mattix to amend Montgomery County Resolution 04-89 and Montgomery County Resolution 05-54 as follows:  Pursuant to K.S.A. 79-251, and having complied with these requirements, the governing body of Montgomery County approves the Constitutional Amendment Provisional to allow abatement, with the creation of 50 additional employees, to American Insulated Wire, Coffeyville, Kansas.  The term for which the exemption will be granted is 10 years (2005 through 2014).  The exemption is being granted for equipment valued at $2,872,292.52 with a complete detailed list of this equipment attached and incorporated into this resolution.  Motion was seconded by Commissioner Tucker.
