The Board of County Commissioners, three members and the County Clerk present, met in regular session at 7:00 PM.

CALL TO ORDER: Commissioner Mattix.
INVOCATION: Commissioner Mattix.
PLEDGE OF ALLEGIANCE: Commissioner Tucker.
AGENDA APPROVAL:
ACTION: A motion was made by Commissioner Lewark-Wood to approve the agenda as amended. The motion was seconded by Commissioner Tucker.

APPROVAL OF PAYMENT OF INVOICES:
ACTION: A motion was made by Commissioner Tucker to approve invoices in the amount of $5,000.00as presented by the County Clerk’s office. The motion was seconded by Commissioner Lewark-Wood.

RURAL FIRE DIRECTOR – WILBUR SCHWATKEN:
Wilbur Schwatken, Montgomery County Rural Fire Director, presented a request for a 4 wheel drive, 500 gallon pump truck for the Tyro Fire Department. Representatives of the Fire Board were present and the request for the truck and repairs requested are at their recommendation. The following action was taken:
ACTION: A motion was made by Commissioner Mattix to authorize the Rural Fire Director to obtain bids for a 4 wheel drive cab and chassis 17500 GVW truck at an estimated cost of $28,000.00. Motion was seconded by Commissioner Wood..

Commissioner Tucker asked that the District look at bigger pumps.
Motor repair was requested. The following action was taken:
ACTION: A motion was made by Commissioner Tucker to authorize the repair of a motor for the Tyro Fire Department and the repairs to be made by Richard Wells &Jarod Powers at an estimated cost of $2,538.00. Motion was seconded by Commissioner Lewark-Wood.

MONTGOMERY COUNTY RURAL FIRE #1 (Continued):
Commissioner Tucker asked Mr. Schwatken call the State and request inspections be made with a state inspector of all premises requesting cereal malt beverage licenses. Also, that Mr. Schwatken be designated as the Code Enforcement Officer and this be added to his job description. The following action was taken:
ACTION: A motion was made by Commissioner Tucker that the Montgomery County Rural Fire Coordinator be designated as the Code Enforcement Officer and this be added to the Coordinator’s job description by Human Resources. Motion was seconded by Commissioner Lewark-Wood.

KANSAS ASSOCIATION OF COUNTIES:
Coffey County Commissioner, Gene Merry, Labette County Commissioner and Randy Allen, Kanas Association of Counties Director, met with the Board and voiced their concern that Montgomery County is not participating in KAC for 2005. They advised the Board they work on behalf of all counties in Kansas and encouraged our county’s participation. No action was taken.

ROBERT PIERCE – COUNTY EMPLOYEES AND INSURANCE:
Mr. Pierce met with the Board to voice concerns on the hiring of additional employees and the cost of insurance. He discussed the following:

OTHER COUNTY BUSINESS:
Mr. Ray Rinck and Mr. Jr. Smith address concerns on crowning of roads and a whistle being plugged on CR 4315 causing the water to go over the road. Public Works will look at the problem.
A letter from the Montgomery County Solid Waste Committee was presented with recommendations for the review of the Montgomery County Solid Waste Plan. The following action was taken:
ACTION: A motion was made by Commissioner Lewark-Wood to accept the report of the Montgomery County Solid Waste Committee and to approve the recommendations of the Committee as presented for the Montgomery County Solid Waste Plan. Motion was seconded by Commissioner Tucker.

The Board clarified this would be retroactive back to a 90 day probationary period instead of six (6) months.
Commissioner Tucker asked for the number of employees attending and the amount the county has paid for attendance to fire academies.
