The Board of County Commissioners, three members and the County Clerk present, met in regular session at 9:00 AM.

CALL TO ORDER:  Commissioner Hey.

INVOCATION:  Commissioner Taylor.

PLEDGE OF ALLEGIANCE:  Commissioner Mattix.

AGENDA APPROVAL:

ACTION:   A motion was made by Commissioner Taylor to approve the agenda as amended.  The motion was seconded by Commissioner Mattix.

APPROVAL OF MINUTES:

ACTION:  A motion was made by Commissioner Taylor approve the minutes of December 27, 2004 as presented by the County Clerk.  The motion was seconded by  Commissioner Mattix.

APPROVAL OF PAYMENT OF INVOICES:

ACTION:  A motion was made by Commissioner Taylor to approve invoices in the amount of $9,871.00 and $220,999.20 as presented by the County Clerk’s office.   The motion was seconded by Commissioner Mattix.

COUNTY APPRAISER – EXECUTIVE SESSION – LEGAL ISSUES:

This session was postponed until the next meeting due to County Counselor not being present.

SHERIFF’S DEPARTMENT – EXECUTIVE SESSION – NON-ELECTED PERSONNEL:

ACTION:  A motion was made by Commissioner Mattix to recess to Executive Session at 9:32 AM to return at 9:50 AM with Richard George and Stan Veach present to discuss non-elected personnel.  Motion was seconded by Commissioner Taylor.

                                               Commissioner Mattix - Yes

                                               Commissioner Taylor - Yes

Returned from Executive Session at 9:50 AM with the following motion:

ACTION:  A motion was made by Commissioner Hey to extend the Executive Session for non-elected personnel from 9:52 AM to 10:02 AM with Richard George and Stan Veach present to discuss non-elected personnel.  Motion was seconded by Commissioner Mattix.

Returned from Executive Session at 10:02 AM with no action taken and no decisions made.

Mr. George announced to the Board Bob Booth has been appointed Department of Corrections Administrator effective 8:00 AM January 3, 2005.  Julie McConnell will serve Assistant Jail Administrator.

PUBLIC WORKS:

Barbara Curtis, Public Works Coordinator, advised the Board of road damage across from Coffeyville Resources, Inc. caused by farm equipment.  Temporary repair has been done and the final repair will not be completed until warm weather for asphalt.  Damage cost will be assessed to the individual.

EXECUTIVE SESSION:

ACTION:  A motion was made by Commissioner Mattix to recess to Executive Session at 10:10 AM to return at 10:25 AM to discuss non-elected personnel with Barbara Curtis present.  Motion was seconded by Commissioner Taylor.

OTHER COUNTY BUSINESS:

1.      Cereal Malt Beverage Licenses (2) –

ACTION:  A motion was made by Commissioner Mattix to approve the issuance of Cereal Malt Beverage Licenses for Sassy’s Bar & Grill, Sycamore, Kansas and Southgate, Independence, Kansas for “consumption on the premises”.  Motion was seconded by Commissioner Taylor.

2.      Transfer of Inmate Funds for 2004 –

ACTION:  A motion was made by Commissioner Hey to transfer unclaimed inmate funds in the amount of $18.81 to the General Fund for the year 2004.  Motion was seconded by Commissioner Taylor.

3.      Amend Resolution 04-192 – Special Parks Distribution –

ACTION:  A motion was made by Commissioner Taylor to amend Resolution 04-192 to include funds received in December, 2004 for distribution to Special Parks Fund from Local Alcoholic Liquor Tax Funds.  Total amount distributed is $11,572.00.  Motion was seconded by Commissioner Mattix.
