The Board of County Commissioners, three members and the County Clerk present, met in special session at 10:30 AM.

CALL TO ORDER: Commissioner Hey.
INVOCATION: Commissioner Mattix.
PLEDGE OF ALLEGIANCE: Commissioner Hey.
AGENDA APPROVAL:
ACTION: A motion was made by Commissioner Hey to approve the agenda as amended. The motion was seconded by Commissioner Mattix.

FENCE DISPUTE – TRUITT/WEHMEYER:
Commissioner Mattix presented cost figures for materials and labor for the fence discussed at the previous fence viewing for Mr. Truitt and Wehmeyers. The total cost for 1,428.7 feet of fencing would be $771.50 with the total cost shared it would be $385.75 each. The following action was taken:
ACTION: A motion was made by Commissioner Hey to approve the information compiled and issue the letter advising Mr. Corey Truitt and Mr. and Mrs. Gerald Wehmeyer the total cost as determined by the Board of County Commissioners as Fence Viewers, is $771.50 and to be divided equally at a cost of $385.75 each. Motion was seconded by Commissioner Mattix.

AMEND RESOLUTION 04-170 – EMPLOYEE’S FILE INFORMATION:
ACTION: A motion was made by Commissioner Hey to amend RES. 04-170 to include “expunge grievance proceeding documentation and disciplinary action from Josh Warner’s employee records per recommendation from Acting Sheriff Richard George”. Motion was seconded by Commissioner Mattix.

PAYROLL & EXPENDITURE OUTSTANDING CHECKS TO BE VOIDED:
ACTION: A motion was made by Commissioner Mattix to approve the voiding of outstanding payroll checks for the year 2001 in the amount of $438.86 and outstanding expenditure checks for the year 2001 in the amount of $1.353.93. Motion was seconded by Commissioner Taylor.

LOCAL ALCOHOL LIQUOR TAX DISTRIBUTION:
ACTION: A motion was made by CommissionerTaylor to approve the distribution of the Local Alcoholic Liquor Tax Funds by population prorated to all Incorporated cities in Montgomery County for Special Parks and Recreation. Motion was seconded by Commissioner Hey.

COMPUTER DEPARTMENT:
Ken Collins, Computer Director, requested approval to attend a 2 day PC training seminar to be held February 17 and 18 in Salina. Approval was given by the Board.

OTHER COUNTY BUSINESS:
1. Sign Service Awards for Employees.
2. Evaluations – Appointed Department Supervisors.
ACTION: A motion was made by Commissioner Taylor to recess to Executive Session at
10:42 AM to return to session at 11:12 AM to discuss non-elected personnel for the purpose of evaluating appointed department supervisors for the year 2004. Motion was seconded by Commissioner Hey.

Returned to session at 11:12 AM with no action taken and no decisions made.
Discussion: Evaluations were discussed and completed for employee’s files.
