BOARD OF COUNTY COMMISSIONERS MONTGOMERY COUNTY, KANSAS OFFICIAL MINUTES October 18, 2004
The Board of County Commissioners, three members and the County Clerk present, met in regular session at 9:00 AM. ******** CALL TO ORDER: Commissioner Hey. INVOCATION: Commissioner Mattix. PLEDGE OF ALLEGIANCE: Commissioner Taylor.
AGENDA APPROVAL: ACTION: A motion was made by Commissioner Mattix to approve the agenda as amended. The motion was seconded by Commissioner Taylor. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes ******** APPROVAL OF PAYMENT OF INVOICES: ACTION: A motion was made by Commissioner Taylor to approve invoices in the amount of $815.61 and $445,080.82 as presented by the County Clerk’s office. The motion was seconded by Commissioner Mattix. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes ******** WALLICK ROAD COMPLAINT: County Road 459 was discussed with Mr. and Mrs. Jesse Wallick. Dart Gas Company rocked the road and scattered rock through the fields. They keep widening out turns as they turn with big trucks and equipment. Mr. Kelly is the attorney for Mr. Wallick and Mr. Wallick is under the impression the road is a private road on his property. The Wallicks were referred to Mr. Paul Kritz, County Counselor and the Road and Bridge Department.

CREDIT CARD REQUEST – SHERIFF’S DEPARTMENT: Richard George, Acting Sheriff, requested credit cards be issued to Mike McCartney and Ron Wade as transportation officers. Steve Fryback and Jimmie Rogers cards will be cancelled. The following action was taken:
ACTION: A motion was made by Commissioner Hey to approve the issuance of two (2) additional credit cards to the Sheriff’s Department in the names of Mike McCartney and Ron Wade. Motion was seconded by Commissioner Taylor. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes Res. No. 04-158 ******** MIKE DAVIS – PROBLEM WITH SHERIFF’S DEPARTMENT: Mr. and Mrs. Mike Davis appeared before the Board to discuss a problem with the Sheriff’s Department in the Sycamore area. They stated they had reported $10,000 theft to the Sheriff’s Department and part of the stolen property was found but nothing was done about it. The Board advised Mr. and Mrs. Davis they have no authority over the Sheriff’s Department except for budget and they would need to talk to the County Attorney.
******** PUBLIC WORKS: Barbara Curtis, Public Works Coordinator, presented the weekly written report. The following items were discussed: Graveling report; Request for road vacation of County Road 1600-06 between sections 3 and 10, set for November 15th at 8:30 AM; Requested new air compressor for the field service truck; Requested permission to purchase two (2) flex wing mowers; and award of pipe bid. As a result of this report, the following action was taken:
ACTION: A motion was made by Commissioner Mattix to approve the purchase of an air compress for the field service truck at the cost of $1,564.20 to be debited from the Road and Bridge Fund. Motion was seconded by Commissioner Taylor. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes Res. No. -4-159 ACTION: A motion was made by Commissioner Hey to authorize Public Works to obtain bids for two (2) flex-wing mowers. Motion was seconded by Commissioner Taylor. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes ACTION: A motion was made the bid for 12”x24’ steel pipe to Cleaver Farm & Home, Chanute, Kansas at a total cost of $8,011.20 and 12” x 24’ and 15” x 24’ galvanized pipe to Welborn Sales, Gardner, Kansas in the amount of $5,304.00. Debit Road and Bridge Fund a total of $13,315.20. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes Res. No. 04-160 ********
CITY OF COFFEYVILLE – NEIGHBORHOOD REVITALIZATION INTERLOCAL AGREEMENT: ACTION: A motion was made by Commissioner Hey to adopt the Neighborhood Revitalization Interlocal Agreement between Montgomery County and the City of Coffeyville as presented by City Manager Jeff Morris to expire July 1, 2020. Motion was seconded by Commissioner Mattix. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes Res. No. 04-161 ******** Recessed at 10:35 AM. Returned at 10:40 AM. ******** EXECUTIVE SESSION : ACTION: A motion was made by Commissioner Hey to recess to Executive Session at 10:40 AM to return at 11:00 AM with Julie McConnell present at the request of the Board. Motion was seconded by Commissioner Mattix. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes
Returned to session at 11:00 AM with no action taken and no decisions made.
