The Board of County Commissioners, three members and the County Clerk present, met in special session at 9:00 AM.

CALL TO ORDER:  Commissioner Hey.

INVOCATION:  Commissioner Hey.

PLEDGE OF ALLEGIANCE:  Commissioner Mattix.

COUNTY ROAD 459 – GATE CLOSING DISPUTE:

Mr. Bill Fitzpatrick, Attorney, met with the Board on behalf of Bob and Elaine McDaniel to discuss a gate being erected on County Road 459 by Dart Oil Company.  This road is the only access to Mr. McDaniel’s farm land and according to Mr. Fitzpatrick Mr. Wallick, the other landowner involved and Dart Oil have violated K.S.A. 68-545.

Barbara Curtis, Public Works Coordinator, was present for the meeting and reaffirmed that County Road 459 is a county road which is open to the public and has never been officially closed by the county.

Montgomery County Counselor Paul Kritz was present for the meeting and agreed that obstruction of a public road is a criminal offense.  The Board authorized Mr. Kritz to work with Mr. Fitzpatrick to resolve this matter.

NEIGHBORHOOD  REVITALIZATION MEETING:

City representatives met at 9:00 AM for a meeting to discuss Neighborhood Revitalization plans throughout the county.  Those present for the meeting were:  Paul Kritz, Cherryvale City Administrator/City Clerk Becky Brown, Independence City Manager Paul Sasse, Coffeyville City Manager Jeff Morris, MCAC Director Dennis Pruitt, Caney City Administrator Don Whitman, Board of County Commissioners, County Clerk and Deputy County Clerk Dahrla Hinton.

Plans were discussed that are now in force in Montgomery County.  Each plan is somewhat different and the abatement scales are different in various cities.  The Board of County Commissioners would like to see consistent plans throughout the county if possible.  After discussion it was decided the city representatives will meet and discuss plans for a more consistent plan for neighborhood revitalization in the county and meet again with the Board of County Commissioners.  The Board of County Commissioners acknowledged the fact this cannot be done all at once due to the fact several plans are now in effect and cannot be changed but that future plans would be more uniform.
