The Board of County Commissioners, three members and the County Clerk present, met in regular session at 9:00 AM.

CALL TO ORDER:  Commissioner Hey.

INVOCATION:  Commissioner Mattix.

PLEDGE OF ALLEGIANCE:  Commissioner Hey.

 

AGENDA APPROVAL:

ACTION A motion was made by Commissioner Mattix to approve the agenda as amended.  The motion was seconded by Commissioner Taylor.

APPROVAL OF MINUTES:

ACTIONA motion was made by Commissioner Taylor approve the minutes of July 19, 2004 as presented by the County Clerk.  The motion was seconded by  Commissioner Mattix.

APPROVAL OF PAYMENT OF INVOICES:

ACTION:  A motion was made by Commissioner Mattix to approve invoices in the amount of $14,645.94 as presented by the County Clerk’s office.   The motion was seconded by Commissioner Taylor.

MONTGOMERY COUNTY ACTION COUNCIL – NEIGHBORHOOD REVITALIZATION:

Dennis Pruitt, Montgomery County Action Council Director, met with the Board to discuss the Enhancement Application for Coffeyville City Neighborhood Revitalization .  Commissioner Taylor stated he is against the 100% rebate for five (5) years for the city of Coffeyville’s plan and all agreement dates between the cities and county should expire on the same date.

A meeting will be requested with all city administrators and city managers, Mr. Pruitt, County Commissioners and the County Clerk to discuss the neighborhood revitalization plans and to work towards consistency in the plans.  Commissioner Hey and Commissioner Taylor will draft a letter to these individuals.

REGISTER OF DEEDS – COMPUTER PURCHASE:

Marilyn Calhoun, Register of Deeds, met with the Board to request approval to purchase a computer to replace one currently in her office.  The following action was taken:

ACTION:  A motion was made by Commissioner Taylor to authorize the purchase of one (1) computer for the Register of Deeds Office to be debited from the Register of Deeds Technology Fund.  Motion was seconded by Commissioner Hey.

Ms. Calhoun also requested approval to purchase a dehumidifier for the office to eliminate damage to the record books due to the humidity.  The following action was taken:

ACTION:  A motion was made by Commissioner Hey to approve the purchase of a dehumidifier from the Capital Outlay Fund for the Register of Deeds Office at an estimated cost of $350.00.  Motion was seconded by Commissioner Mattix.

MONTGOMERY COUNTY RURAL FIRE – TANK & PUMP BIDS:

Wilbur Schwatken, MCRF#1 Director, presented bids for two (2) pumps and one (1) water tank.  Bids were as follows:

Portable Pump:

Chief Fire and Safety Co., Chickasha, OK                                        $4,984.00 did not meet specifications

Weis Fire & Safety Equip., Salina, KS                                              $6,189.54

Emergency Fire Equipment, Mayfield, KS                                       $6,758.00

Jerry Ingram/Fire & Rescue, Shawnee Mission, KS                       $7,402.00 without control panel

ACTION:  A motion was made by Commissioner Taylor to approve the purchase of two (2) portable pumps for Montgomery County Rural Fire District #1 and accept the recommendation of the MCRF#! Director for the low bid of $6,189.54 for both pumps from Weis Fire and Safety Equipment, Salina, KS.  Debit MCRF#1 Fund.  Motion was seconded by Commissioner Mattix.

ACTION:  A motion was made by Commissioner Mattix to approve the purchase of one (1) water tank for Montgomery County Rural Fire District #1 and accept the low bid of $1490.00  from KBK Industries, Inc., Rush Center, KS.  Debit MCRF#1 Fund.  Motion was seconded by Commissioner Mattix.

PUBLIC WORKS:

Barbara Curtis, Public Works Coordinator, advised the Board the aerial maps have arrived for the county.  She also presented a letter from Kansas Department of Health & Environment on the closed landfill inspection.

MONTGOMERY COUNTY SHERIFF – VEHICLES & EXECUTIVE SESSION:

Sheriff Daniels presented information on used patrol vehicles at Joe Watt Sales in Vinita, Oklahoma to replace two (2) vehicles which we have received insurance settlements.  The cost of each vehicle will be $6600 and $8500.  The following action was taken:

ACTION:  A motion was made by Commissioner Taylor to approve the purchase of two (2) vehicles for the Sheriff’s Department from Joe Watt Sales, Vinita, Oklahoma in the amounts of $6,600 and $8,500 to be paid from County Capital Outlay Fund.  Motion was seconded by Commissioner Mattix.

ACTION:  A motion was made by Commissioner Hey to recess to Executive Session at 10:30 AM to return at 10:50 AM with Sheriff Jack Daniels, Julie McConnell and Shirley Webber and the Board of County Commissioners present to discuss non-elected personnel.  Motion was seconded by Commissioner Mattix.

ROLL CALL VOTE – Commissioner Hey - Yes

                                               Commissioner Mattix - Yes

                                               Commissioner Taylor - Yes

Returned to session at 10:48 AM with no decisions made and no action taken.

ACTION:  A motion was made by Commissioner Taylor to recess to Executive Session at 10:50 AM to return at 11:00 AM with the Board present to discuss non-elected personnel.  Motion was

Returned to session at 11:00 AM with no action taken and no decisions made.

ACTION:  A motion was made by Commissioner Taylor to recess to Executive Session at

11:02 AM to return at 11:12 AM with the Board and Jim Shontz present to discuss non-elected

personnel.  Motion was seconded by Commissioner Mattix.

                                               Commissioner Taylor - Yes

Returned to session at 11:12 AM to request extension of the Executive Session.

ACTION:  A motion was made by Commissioner Hey to return to Executive Session at 11:13 AM to return to session at 11:25 AM with the Board and Jim Shontz present to discuss non-elected personnel.  Motion was seconded by Commissioner Mattix.

Returned to session at 11:25 AM with no action taken and no decisions made.

 

COUNTY APPRAISER:

Discussion followed the Executive Session on the appointment to fill the unexpired contract for the County Appraiser.  Mr. Shontz was present for the discussion.  The following action was taken:

ACTION:  A motion was made by Commissioner Mattix to appoint Mr. Jim Shontz, Certified General Appraiser by the Kansas Real Estate Appraiser Board, to fill the unexpired contract as Montgomery County Appraiser for the period August 2, 2004 thru July 30, 2005 at a yearly salary of $42,500.00.  Motion was seconded by Commissioner Taylor.
