BOARD OF COUNTY COMMISSIONERS MONTGOMERY COUNTY, KANSAS OFFICIAL MINUTES July 19, 2004 The Board of County Commissioners, three members and the County Clerk present, met in regular session at 9:00 AM.
******** CALL TO ORDER: Commissioner Hey. INVOCATION: Commissioner Mattix. PLEDGE OF ALLEGIANCE: Commissioner Hey.
AGENDA APPROVAL: ACTION: A motion was made by Commissioner Mattix to approve the agenda as amended. The motion was seconded by Commissioner Taylor. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes ******** APPROVAL OF MINUTES: ACTION: A motion was made by Commissioner Mattix approve the minutes of July 12, 2004 as presented by the County Clerk. ******** APPROVAL OF PAYMENT OF INVOICES: ACTION: A motion was made by Commissioner Taylor to approve invoices in the amount of $421,344.30, $22,726.77 and $68.00 as presented by the County Clerk’s office. The motion was seconded by Commissioner Mattix. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes
******** FENCE VIEWING REQUEST – CORY TRUITT: Mr. Cory Truitt presented a request to the Board for a fence viewing to settle a dispute on payment of materials and labor for 1428.7 feet of fence line. Mr. Gerald Wehmeyer is the adjoining landowner. Mr. Truitt stated he also wants to establish the fence line as being in place 15 years to determine the boundary lines of the land. Mr. Truitt will return to the next meeting and Paul Kritz will be asked to attend. No action was taken at this time.
******** 2005 COUNTY BUDGET: Larry Wright met with the Board to continue the budget discussion for 2005. The budget was finalized and the following action taken: ACTION: A motion was made by Commissioner Taylor to publish the county budget for 2005 and set the budget hearing for 9:30 AM, August 9, 2004. Motion was seconded by Commissioner Mattix. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes
******** PUBLIC WORKS: Barbara Curtis, Public Works Coordinator, presented the weekly written report. The following items were discussed: Bridge deck pouring; Annual Landfill Inspection; Discussion on asphalting road in Woodland West Addition and Tour of Department of Corrections. (The tour was postponed until the next meeting.) Ms. Curtis asked approval to close for the funeral of Vasco Brown’s father. Approval was given.
******** EXECUTIVE SESSION: ACTION: A motion was made by Commissioner Hey to recess to Executive Session at 11:00 AM to return at 11:05 AM with Liz Schwatken present to discuss non-elected personnel. Motion was seconded by Commissioner Taylor. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor – Yes Returned to session at 11:05 AM with no action taken and no decisions made. Discussion: Commissioner Hey discussed the letter received from Jerry Williams resigning his position as Jail Administrator at the request of Sheriff Daniels effective today (July 19, 2004). The following action was taken: ACTION: A motion was made by Commissioner Mattix to accept the resignation of Jerry Williams as Jail Administrator at the request of Sheriff Daniels effective July 19, 2004 and to authorize the positing of the position with the salary based on qualifications. Motion was seconded by Commissioner Taylor. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor – Yes RES. NO. 04-115 ******** OTHER COUNTY BUSINESS: 3. Abatements: ACTION: A motion was made by Commissioner Taylor to approve abatements in the amount of $181,196.79. Motion was seconded by Commissioner Mattix. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor – Yes 2. Labette County Community College Agreement: ACTION: A motion was made by Commissioner Mattix to authorize the Chairman to sign the agreement between Labette County Community College and Montgomery County for Fireman’s Instruction classes to be used by all county fire personnel for the year 2004-2005. Motion was seconded by Commissioner Taylor. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor – Yes RES. NO. 04-116 3. Appraiser’s Position: Discussed the appraiser’s position and requested Executive Sessions with Jim Shontz and Cheryl Carter. Regulations from the State regarding the position will be obtained by Human Resources. ACTION: A motion was made by Commissioner Mattix to recess to Executive Session at 11:07 AM to return at 11:17 AM with Jim Shontz present. Motion was seconded by Commissioner Taylor. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor – Yes Returned to session at 11:17 AM with no action taken and no decisions made. ACTION: A motion was made by Commissioner Taylor to recess to Executive Session at 11:18 AM to return at 11:28 AM with Cheryl Carter present. Motion was seconded by Commissioner Hey.
