The Board of County Commissioners, three members and the County Clerk present, met in regular session at 9:00 AM.

CALL TO ORDER:  Commissioner Hey.

INVOCATION:  Commissioner Mattix.

PLEDGE OF ALLEGIANCE:  Commissioner Taylor.

AGENDA APPROVAL:

 

ACTION A motion was made by Commissioner Taylor to approve the agenda as amended.  The motion was seconded by Commissioner Mattix.

APPROVAL OF MINUTES:

 

ACTIONA motion was made by Commissioner Taylor approve the minutes of June 7, 10 & 14, 2004 as presented by the County Clerk.  The motion was seconded by  Commissioner Mattix.

APPROVAL OF PAYMENT OF INVOICES:

 

ACTION:  A motion was made by Commissioner Mattix to approve invoices in the amount of $17,566.57 and $280,643.11 as presented by the County Clerk’s office.   The motion was seconded by Commissioner Taylor.

MONTGOMERY COUNTY EXTENSION COUNCIL BUDGET – 2005:

 

Scott Gordon, Carl Hamilton, Nancy Hamilton, Michael Springer, Irene Santee and Jerry Hall met with the Board to present the request for the Montgomery County Extension Council Budget in the amount of $233,777.  No action was taken at this time.

DISTRICT COURT – JUDGE DENT – AG OPINION ON BUDGET AUTHORITY:

Judge Dent presented an Attorney General Opinion regarding budget authority for the District Court.  The subject was discussed due to invoices submitted for a retirement function for which the payment is against county policy.  Invoices were paid as presented.  The AG Opinion is on file in the County Clerk’s office.

There was some discussion on the public defenders office.  There are two attorneys and office space will be needed.  At the present time office space in the Independence Corporate Office Building would be the most convenient.  There will be further discussion at a later date.

 

MONTGOMERY COUNTY RURAL FIRE #1 – WATER TANK BID:

Wilbur Schwatken met with the Board to present the bids for  the 500 gallon water tank for the new fire truck at Sycamore.  Bids were as follows:

Chief Fire & Safety Co., Chickasha, OK                                                           $2,420.00

Emergency Fire Equip., Mayfield, KS                                                               $2,157.00

KBK Industries, Inc., Rush Center, KS                                                            $1,614.00

 

ACTION:  A motion was made by Commissioner Mattix to approve the low bid for one (1) 500 gallon water tank to be purchased for Montgomery County Rural Fire District No. 1, Sycamore Station, from KBK Industries, Inc., Rush Center, KS in the amount of $1,614.00 to be debited from Montgomery County Rural Fire District No. 1 Fund.  Motion was seconded by Commissioner Taylor.

Mr. Schwatken was asked by the Board to remain at the meeting for an Executive Session as soon as the other business was completed.

PUBLIC WORKS:

Barbara Curtis, Public Works Coordinator, presented the weekly written report.  The following items were discussed:  Completion of asphalt work on Sunflower Road and present work; Work on Bridge; Mowing of roadsides; New carpet installation is complete; and report on monthly collection day for HHW.

EXECUTIVE SESSION:  A motion was made by Commissioner Hey to recess to Executive Session at 10:07 AM to return at 10:25 AM to discuss non-elected personnel with Wilbur Schwatken present.  Motion was seconded by Commissioner Taylor.

                                               Commissioner Mattix - Yes

                                               Commissioner Taylor - Yes

 

Returned to session at 10:25 AM with no action taken and no decisions made.

Mr. Schwatken discussed the possibility of working part time for the remainder of June and becoming full time July 1st.  The Board approved Mr. Schwatken working part time effective June 21, 2004 and starting full time July 1, 2004.  He was instructed to maintain a time sheet with hours worked to be turned into the payroll department for part time work.

A desk , telephone and supplies will be made available to Mr. Schwatken in the basement of the Courthouse in the area of the Computer Department.  Commissioner Hey will contact Ken Collins for available space.

FOUR COUNTY MENTAL HEALTH – 2005 BUDGET:

Greg Hennen representing Four County Mental Health, presented the 2005 budget request to the Board in the amount of $361,316.00 plus the Special Alcohol Tax.  No action was taken at this time.

ENVIRONMENTAL HEALTH/ZONING – CLEANUP PROJECT – KDHE:

Scott Barnhart, Environmental Health/Zoning Director, presented information on a cleanup project to be partially funded by Kansas Department of Health & Environment located at 19th & Cherry Streets in Independence.  Initially the cost to the county for the cleanup was thought to be somewhere around $5,000 to $6,000 plus the in-kind services.  Due to the cost for disposal at the landfill, the total cost will be $32,042.00; $8,792.00 in-kind services, $23,250.00 disposal cost with KDHE funding $10,000.00.  The total amount for the county’s share would be $13,250.00 plus the in-kind services.  The project has been put on hold and Mr. Barnhart is further investigating some avenues for the cleanup project.

 

COMPLAINT ON SHERIFF – CAMPAIGN PRACTICES:

Bill Linn, Linn’s Air Cooled Engines, met with the Board to discuss the county’s procedure for obtaining services for repairs, etc.  He told the Board he had been contacted by Sheriff Daniels because Mr. Linn had allowed a candidate for sheriff place a sign on his property.  He said Mr. Daniels gave him to understand he would not receive any more county business or his family business.

Mr. Linn was advised the procedure for a complaint would be to contact the Ethics Commission in Topeka and the County Attorney.

OTHER COUNTY BUSINESS:

1.       Emergency Preparedness Mechanic/Truck Driver Position –

 

ACTION:  A motion was made by Commissioner Taylor to approve Walter Ward, a retired county employee, to fill the position of Emergency Preparedness mechanic/truck driver after a 30 day break in service from Montgomery County.  The salary is set at $200.00 per month.  Motion was seconded by Commissioner Mattix.
