The Board of County Commissioners, three members and the County Clerk present, met in regular session at 9:00 AM.

APPROVAL OF MINUTES:

APPROVAL OF PAYMENT OF INVOICES:
ACTION: A motion was made by Commissioner Taylor to approve invoices in the amount of $21,795.63, $25,908.07, $174,661.61 and $1,102.50 as presented by the County Clerk’s office. SHERIFF VEHICLE BIDS:
Sheriff Jack Daniels presented the bids for three (3) patrol vehicles for the Sheriff’s Department. Bids were as follows:
Quality Motors, Independence, KS $66,590.40 Ford of Tulsa, Tulsa, OK $66,555.00 Joe Watts Auto Sales, Vinita, OK $68,331.00 Columbus Ford, Mercury, Columbus, KS $70,200.00
ACTION: A motion was made by Commissioner Taylor to approve the bid for three (3) patrol vehicles for the Montgomery County Sheriff’s Department from Quality Motors in the amount of $66,590.40 to be debited from County General Operating Fund. Sheriff Daniels discussed a letter from Sylvia Augustine, Secretary for Southeast Kansas Tactical Rescue and Recovery Team proposing to the Sheriff’s Department to place the loaned Kawasaki wave runner on the county’s insurance policy and the Team reimburse any additional expense to the county.
The County Clerk was instructed to check with our insurance carrier if this can be placed on county policy.

ENVIRONMENTAL HEALTH – ILLEGAL DUMP CLEANUP CONTRACT:
Scott Barnhart, Environmental Health Director, presented the Illegal Dump Cleanup Contract between Montgomery County and KDHE for the cleanup program at 19th & Cherry, Independence. The work plan will be submitted, with numbers for cost, to the Chairman for the next meeting. The contract will not be approved until all costs have been documented.

HUMAN RESOURCES:
Liz Schwatken, Human Resources Director, presented a Shared Leave Request from the Environmental Health/Zoning Department. The following action was taken:
ACTION: A motion was made by Commissioner Mattix to approve the Shared Leave Request as submitted by the Human Resources Department for employee in the Environmental Health/Zoning Department. PUBLIC WORKS:
Barbara Curtis, Public Works Coordinator, presented the weekly written report. The following items were discussed: Road and Bridge Work Report; Retirement of Walt Ward; Request to vacate Taylor Avenue in Caney. Viewing date set for June 28th at 8:30 AM; Award of Pipe Bid; Noxious Weed Annual Weed Management Plan; and Building Maintenance (Carpet being laid in Human Resources and County Health Department in Coffeyville). As a result of this report, the following action was taken:
ACTION: A motion was made by Commissioner Taylor to accept the low bid of $6,694.20 for new corrugated pipe from J & J Metal Products, Paola, Kansas for Road and Bridge Department. Motion was seconded by Commissioner Hey. Debit Road and Bridge Fund $4,159.20 and Special Bridge $2,535.00. ACTION: A motion was made by Commissioner Taylor to authorize the Chairman to sign the Annual Weed Management Plan on behalf of Montgomery County for the Noxious Weed Department. MONTGOMERY COUNTY TREASURER – PRINTER BIDS:
Billie Lewark-Wood presented bids for 2 IBM printers for the Montgomery County Treasurer’s office. Bids were as follows:
Huber & Associates, Springfield, MO $1,885.00 Infinitec , Marion, KS $1,965.00 Nex-Tech, Hays, KS $1,945.00
ACTION: A motion was made by Commissioner Taylor to approve the low bid for two (2) IBM printers for the Montgomery County Treasurer’s Office from Huber & Associates, Springfield, MO in the amount of $1,885.00 plus 1 Year Extended Warranty in the amount of $89.00 each. Debit County General Capital Outlay Fund. Motion was seconded by Commissioner Mattix. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes RES. 04-96

MONTGOMERY COUNTY RURAL FIRE DISTRICT NO. 1 DIRECTOR – SCREENING COMMITTEE REPORT:
ACTION: A motion was made by Commissioner Hey to recess to Executive Session at 10:25 AM to return at 10:45 AM with Don Whitman, Committee Chairman, present to discuss non-elected personnel. Motion was seconded by Commissioner Taylor. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes
Returned to session at 10:45 AM with no action taken and no decisions made.
ACTION: A motion was made by Commissioner Taylor to return to Executive Session at 10:45 AM to return at 11:00 AM with Don Whitman, Committee Chairman, present to discuss non-elected personnel. Returned to session at 10:55 AM with no action taken and no decisions made.
Discussion began at 11:00 AM on the Screening Committee Report and recommendations for Montgomery County Rural Fire Director. Mr. Donald Whitman, Caney City Administrator and Chairman of the Committee presented a letter to the Board with the recommendations for three (3) top applicants as determined by the Committee of five (5) members. The recommendations were in no particular order: James VanSchaick, Billy Roberts and Wilbur Schwatken III.
Mr. Whitman explained to the Board the process for the final recommendation of these applicants. He stated each of the 16 applicants was matched to qualifications and job description and ranked by the Committee members 1 thru 16. Ten of these applicants were ruled out, leaving six (6) applicants to be narrowed to the best three (3). Mr. Whitman stated that based on qualifications and requirements for the job the Committee agreed on the top three (3) applicants for submitting to the Board of County Commissioners.
The Board thanked Mr. Whitman and the Committee for their professionalism and work in screening these 16 applicants. Interviews will be set for Thursday, June 10th in the Commission Meeting Room and the three (3) individuals will be notified of the time they will be interviewed.
******** AUDIT – 2003 ENGAGEMENT LETTER – HUTINETT, SCHLOTTERBECK & BURNS:
Harley Schlotterbeck presented an Engagement Letter for the 2003 Audit to be conducted by their firm for Montgomery County. The following action was taken:
ACTION: A motion was made by Commissioner Taylor to accept and approve the Audit Engagement Letter between Montgomery County and Hutinett, Schlotterbeck and Burns, L.L.C. for the 2003 audit to be performed in 2004 at a cost of $14,900 plus any direct costs to be paid from the County General Operating Fund. Motion was seconded by Commissioner Mattix. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes RES. 04-97

OTHER COUNTY BUSINESS:
1. Request for bids for 500 gallon water tank for Sycamore Rural Fire’s new 1-ton truck –
ACTION: A motion was made by Commissioner Mattix to approve the County Clerk to obtain bids for a 500 gallon water tank for Sycamore Rural Fire’s new 1-ton truck. Motion was seconded by Commissioner Taylor. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes
2. Mileage rate change to 37.5 cents per mile - Discussion:
The State of Kansas has not increased their rate to be the same as the Federal rate as of this time. The Board agreed the county will not increase the rate until the State of Kansas increases.
3. Comprehensive Economic Development Strategy Resolution –
ACTION: A motion was made by Commissioner Taylor to adopt the 2003 Comprehensive Economic Development Strategy of the Southeast Kansas Economic Development District, also known as the Southeast Kansas Regional Planning Commission (SEKRPC). Motion was seconded by Commissioner Mattix. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes RES. NO. 04-98
4. FEMA 2005 Cooperative Agreement –
ACTION: A motion was made by Commissioner Taylor to authorize the Chairman to sign, on behalf of Montgomery County, the Kansas Emergency Management 2005 Cooperative Agreement Program to apply for participation in the FEMA State and Local Assistance Program for 2005. 5. Letter from Judge Dent – Budget Spending Authorization:
The Board discussed the letter from Judge Dent and asked the Clerk to notify the Judge they would like to have a copy of the Kansas Statue referred to in his letter and asked he be placed on the agenda for the next meeting.
