BOARD OF COUNTY COMMISSIONERS MONTGOMERY COUNTY, KANSAS OFFICIAL MINUTES April 12, 2004 The Board of County Commissioners, three members and the Deputy County Clerk present, met in regular session at 9:00 AM. ******** CALL TO ORDER: Commissioner Hey. INVOCATION: Commissioner Taylor. PLEDGE OF ALLEGIANCE: Commissioner Mattix. AGENDA APPROVAL: ACTION: A motion was made by Commissioner Hey to approve the agenda as amended. The motion was seconded by Commissioner Taylor. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes ******** APPROVAL OF MINUTES: ACTION: A motion was made by Commissioner Hey approve the minutes of March 29, 2004 as presented by the County Clerk. The motion was seconded by Commissioner Mattix. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes ******** APPROVAL OF PAYMENT OF INVOICES: ACTION: A motion was made by Commissioner Taylor to approve invoices in the amount of $177,618.05 as presented by the County Clerk’s office. The motion was seconded by Commissioner Mattix. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes ******** CANVASS OF VOTES – CANEY CITY GENERAL ELECTION: ACTION: A motion was made by Commissioner Hey to recess to the Canvass of votes for Caney City General Election at 9:15 AM. Motion was seconded by Commissioner Taylor. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes The canvass was completed at 9:25 AM with no changes to the results of the election. The Board returned to regular session at 9:25 AM. ******** Minutes – April 12, 2004 Page 2 NEIGHBORHOOD REVITALIZATION – COFFEYVILLE CITY: Dennis Pruitt, MCAC Director and Jeff Morris, Coffeyville City Manager met with the Board to discuss a Neighborhood Revitalization Plan for Coffeyville City. The suggested plan is to include Sixth Street to Eleventh Street and Patterson to Elm Streets. They asked it be 100% rebate for five (5) years with a 20% decrease for each year for the next five (5) years. The County Counselor will be asked to check the statute for “transfer of ownership”. No action was taken at this time and will be further discussed after the County Counselors opinion. AIW – EXEMPTION ON PERSONAL PROPERTY (EQUIPMENT): Dennis Pruitt advised the Board American Insulated Wire will be requesting an exemption on personal property. There is a project of approximately 150 new jobs to be created at the facility. ******** AMERICAN DISPOSAL – CHUCK GOFF: Mr. Chuck Goff, American Disposal, presented a Zoning Certification Waste Tire Beneficial Use Permit requesting approval to “use tires to hold down tarp to keep trash from blowing”. ACTION: A motion was made by Commissioner Taylor to approve the use of tires as a means of holding down tarps to keep trash from blowing providing there is no burning or “stacking of tires”. Motion was seconded by Commissioner Mattix. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes RES. NO. 04-60 ******** Recessed at 10:00 AM. Returned at 10:05 AM. ******** PUBLIC WORKS: Recessed from regular meeting to Public Meeting on 5-Year Plan for Public Works at 10:05 AM. The five-year plan includes: East of Coffeyville 0.250 miles; W of Havana 0.250 miles; W of Cherryvale 0.200 miles; W of Caney 0.200; E. of Coffeyville – Verdigris 0.200 miles; E of Coffeyville – Overflow 0.100 miles. There being no public input, the following action was taken: ACTION: A motion was made by Commissioner Mattix to approve the Five-Year Plan for Montgomery County as presented by Public Works Coordination, to be submitted to Kansas Department of Transportation. Motion was seconded Commissioner Taylor. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes RES. NO. 04-61 Returned to regular session at 10:10 AM Carpet Bid: Only one bid was received for the carpeting for Human Resources, Election Room and Coffeyville Office County Health Department. The following action was taken: Minutes – April 12, 2004 Page 3 PUBLIC WORKS (Continued): CARPETING BID - ACTION: A motion was made by Commissioner Taylor to approve the bid from Woods Lumber Company, Independence, Kansas in the amount of $ 8,954.00 for carpeting for Human Resources Department, County Clerk’s Election Room, and Coffeyville County Health Department. Motion was seconded by Commissioner Hey. Debit County Building Fund. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor – Yes RES. NO. 04-62 ******** EXECUTIVE SESSION: ACTION: A motion was made by Commissioner Taylor to recess to Executive Session at 10:15 AM to return at 10:30 AM to discuss non-elected personnel with the Board of County Commissioners present. Motion was seconded by Commissioner Hey. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor – Yes Returned to session at 10:30 AM with no action taken and no decisions made. ******** FOUR COUNTY MENTAL HEALTH – GRANT APPLICATION REQUEST: Judy Wilkins representing Four County Mental Health, met with the Board to present a request for sponsoring for a grant application for Project CORE for non-violent offenders. This grant will be a 50/50 grant with Four County Mental Health providing the 50% matching funds. ACTION: A motion was made by Commissioner Taylor to approve Montgomery County to serve as the sponsoring agency for a grant application for Four County Mental Health for Project CORE for non-violent offenders with Four County Mental Health providing the 50% matching funds. Motion was seconded by Commissioner Hey. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor – Yes RES. NO. 04-63 ******** HUMAN RESOURCES – MONTGOMERY COUNTY FIRE DIRECTOR/COORDINATOR POSITION: The Board asked Liz Schwatken, Human Resources Director, to be present to discuss the Job Description and posting of the position for the Montgomery County Fire Director/Coordinator’s position. The following action was taken: ACTION: A motion was made by Commissioner Mattix to authorize the Human Resources Director to advertise in the local newspapers and State Fire Publications the position of Montgomery County Fire Director/Coordinator. The motion was seconded by Commissioner Taylor. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor – Yes The Board of County Commissioners will conduct the interviews with all applications to be received by May 10th. ACTION: A motion was made by Commissioner Taylor to approve the Job Description as submitted and authorized the Chairman of the Board to sign the completed description. NO. 04-64 Minutes – April 12, 2004 Page 4 HUMAN RESOURCES – MONTGOMERY COUNTY FIRE DIRECTOR/COORDINATOR POSITION (Continued): The County Clerk was directed to send a letter to Montgomery County Rural Fire Board of Trustees requesting a minimum of two (2) recommendations for to be submitted to the Board of County Commissioners for hiring consideration. ******** COUNTY BUSINESS: 1. Cereal Malt Beverage License: ACTION: A motion was made by Commissioner Hey to approve the renewal of a Cereal Malt Beverage Licenses for Caney Golf Club, Caney, Kansas. The motion was seconded by Commissioner Taylor. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor – Yes RES. NO. 04-65 2. County Project Tour with Public Works: ACTION: A motion was made by Commissioner Hey to set aside Thursday, April 29th, 2004 for a “special tour” with Public Works with County Commissioners, County Clerk, Public Works Coordinator and Vasco Brown present. The County Clerk was instructed to advise the Public Works Coordinator of the tour and the date. Motion was seconded by Commissioner Taylor.
