BOARD OF COUNTY COMMISSIONERS MONTGOMERY COUNTY, KANSAS OFFICIAL MINUTES March 15, 2004 The Board of County Commissioners, three members and the County Clerk present, met in regular session at 9:00 AM. ******** CALL TO ORDER: Commissioner Hey. INVOCATION: Commissioner Taylor. PLEDGE OF ALLEGIANCE: Commissioner Hey. AGENDA APPROVAL: ACTION: A motion was made by Commissioner Taylor to approve the agenda as amended. The motion was seconded by Commissioner Mattix. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes ******** APPROVAL OF MINUTES: ACTION: A motion was made by Commissioner Mattix approve the minutes of March 8, 2004 as presented by the County Clerk. The motion was seconded by Commissioner Taylor. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes ******** APPROVAL OF PAYMENT OF INVOICES: ACTION: A motion was made by Commissioner Mattix to approve invoices in the amount of $850.00, $4,979.10, $153,383.06 and $228,147.83 as presented by the County Clerk’s office. The motion was seconded by Commissioner Taylor. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes ******** QUARRY COMPLAINT OWNED BY BEACHNER CONSTRUCTION – BILL CALDWELL: Mr. Bill Caldwell appeared before the Board to issue a complaint against Beachner Construction on the blasting being done and the damage it is doing to his property and he also said health problems are occurring due to the dust. Scott Barnhart, Environmental Health/Zoning Director was also present for the meeting. He stated he had spoke to Mr. Caldwell before on this issue. The Board advised Mr. Caldwell they had no jurisdiction over the quarry and the blasting procedure. Mr. Barnhart advised Mr. Caldwell to contact the State Fire Marshall’s office regarding the blasting and KDHE would have the authority over the health hazards. Mr. Barnhart will provide the contact telephone numbers for these offices to Mr. Caldwell. ******** Minutes – March 15, 2004 Page 2 MONTGOMERY COUNTY RURAL FIRE DISTRICT #1 – TRUCK BED BID: ACTION: A motion was made by Commissioner Mattix to approve the bid from Truck Parts & Equipment, Inc., Wichita, Kansas for a truck bed for Montgomery County Rural Fire District No. 1 in the amount of $5,410.00. Debit Montgomery County Rural Fire District No. 1 Fund. Motion was seconded by Commissioner Taylor. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes RES. NO. 04-44 ******** PUBLIC WORKS: Nothing to report. ******** OTHER COUNTY BUSINESS: 1. Reel to Reel Recording Machine – Request to borrow from teacher at Washington School: ACTION: A motion was made by Commissioner Mattix to donate the old reel to reel recording machine to Washington School for use for the students. Motion was seconded by Commissioner Hey. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes RES. NO. 04-45 2. Encroachment Agreement between Montgomery County and Jim and Becky McDiarmid: ACTION: A motion was made by Commissioner Taylor to accept and authorize the Chairman to sign on behalf of Montgomery County, the Encroachment Agreement between Montgomery County and Jim and Becky McDiarmid as presented by the County Counselor. Motion was seconded by Commissioner Hey. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes RES. NO. 04-46 3. Independence Historic Preservation – Independence City – Request Form: Commissioner Mattix will attend the public meeting Tuesday evening for the discussion and education meeting presented by the Independence Historic Preservation and Resource Commission. 4. Drawdown for Sewer District #2 Grant: ACTION: A motion was made by Commissioner Mattix to authorize the Chairman to sign, on behalf of Montgomery County, the drawdown for Grant Funds for Sewer District No. 2 as presented by the County Clerk and prepared by SEKRPC. Motion was seconded by Commissioner Taylor. ROLL CALL VOTE – Commissioner Hey - Yes Commissioner Mattix - Yes Commissioner Taylor - Yes 5. Discussed the format for the Republican Women’s Club meeting this evening at 6:30 PM.
