 The Board of County Commissioners, three members and the County Clerk present, met in regular session at 9:00 AM.

CALL TO ORDER:  Commissioner Taylor.

INVOCATION:  Commissioner Hey.

PLEDGE OF ALLEGIANCE:  Commissioner Taylor.

AGENDA APPROVAL:

ACTION:   A motion was made by Commissioner Hey to approve the agenda as amended.  The motion was seconded by Commissioner Taylor.

             ROLL CALL VOTE – Commissioner Taylor - Yes

                                               Commissioner Hey - Yes

                                               Commissioner Mattix - Yes

APPROVAL OF MINUTES:

ACTION:  A motion was made by Commissioner Hey approve the minutes of December 22, 2003as presented by the County Clerk.  The motion was seconded by  Commissioner Mattix.

APPROVAL OF PAYMENT OF INVOICES:

ACTION:  A motion was made by Commissioner Taylor to approve invoices in the amount of $1,485.l4, $240.00 and $272,219.16 as presented by the County Clerk’s office.   The motion was seconded by Commissioner Hey.

ROAD CLOSING REQUEST – CR 3200-2 & 3:

 ACTION:  A motion was made by Commissioner Mattix to close CR 3200-2&3 an agreement between landowners that becomes an attachment to this Resolution.  The road is described as follows:

            All of Road 543 (3200 – 2 & 3) as recorded in Road Record Book 3, Page 69 in the Montgomery County Public Works Office located in Section 36, Township 33 South Range 13 East of the 6th Principal Meridian in Montgomery County, Kansas.  Being approximately .25 mile in length and having a Right of Way of 40 feet.

          Also, all of Road 442 (3200 – 2 & 3), as recorded in Road Record Book 2, Page 545 in the Montgomery County Public Works Office located in Section 36, Township 33 South Range 13 East of the 6th Principal Meridian in Montgomery County, Kansas.  Being

CR ROAD 3200-2 & 3 CLOSING (Continued):

 

approximately .25 mile in length and having a Right of Way of 40 feet.  Except that portion already vacated and described as Road 442, in Road Record Book 2, Page 69 in the Montgomery County Public Works Office

 

Also, A portion of Road 43 (3200 – 2 & 3), as recorded in Road Record Book 1, Page 111 in the Montgomery County Public Works Office, located between Sections 30 and 31, Township 33 South, Range 13 East of the 6th Principal Meridian in Montgomery County, Kansas.  Being approximately 1 mile in length and having a Right of Way of 49.5 feet.

 ROAD CONCERN – MR. GARY JABBEN:

 

Mr. Gary Jabben met with the Board to request access off Grant Street and does not want large bump on ridge as a hazard.  Commission offered to put down a load of rock to even area leading into property.  Mr. Jabben reluctantly accepted.

 EXECUTIVE SESSION:

 ACTION:  A motion was made by Commissioner Hey to recess to Executive Session at 9:45 AM to return at 10:05 AM to discuss non-elected personnel.  Motion was seconded by Commissioner Taylor.

ROLL CALL VOTE – Commissioner Taylor - Yes

                                               Commissioner Hey - Yes

                                               Commissioner Mattix - Yes

 

Returned to session at 10:05 AM with no action taken and no decisions made.

 LEASE AGREEMENT – DEARING SCHOOL:

 ACTION:  A motion was made by Commissioner Mattix to authorize the Chairman of the Board sign the lease agreement cancellation for the Dearing School between Dearing City and Montgomery County.  Motion was seconded by Commissioner Taylor.
