APPROVAL OF PAYMENT OF INVOICES:

HUMAN RESOURCES – SHARED LEAVE REQUEST:
Liz Schwatken, Human Resource Director, presented a request from Public Works Department for shared leave for eight (8) hours from Homer Newton to Toby Lawless. The request meets all criteria for shared leave. The following action was taken:
ACTION: A motion was made by Commissioner Hey to approve the request from Public Works Department for eight (8) hours shared leave to be given by Homer Newton to Toby Lawless. Motion was seconded by Commissioner Mattix. ROLL CALL VOTE – Commissioner Taylor - Yes Commissioner Hey - Yes Commissioner Mattix - Yes RES. NO. 03-163

MONTGOMERY COUNTY ACTION COUNCIL – MICRO LOAN APPLICATION: Dennis Pruitt, Montgomery County Action Council Director, presented an application for a loan from the micro loan revolving funds in the amount of $15,000.00 for “Tavern on the Plaza, LLC”. This will create 10 new jobs in Coffeyville and is a five (5) year loan at 4% interest. Mr. Pruitt advised the Board there is a balance of $41,000.00 in the Micro Loan Revolving Account Fund. The following action was taken:
ACTION: A motion was made by Commissioner Hey to approve the Micro Loan from the Micro Loan Revolving Fund in the amount of $15,000.00 for “Tavern on The Plaza, LLC”, Coffeyville, Kansas. Motion was seconded by Commissioner Taylor. ROLL CALL VOTE – Commissioner Taylor - Yes Commissioner Hey - Yes Commissioner Mattix - Yes RES. NO. 03-164

EXECUTIVE SESSION: ACTION: A motion was made by Commissioner Hey to recess to Executive Session at 9:20 AM to return at 9:30 AM with the Commissioners present to discuss non-elected personnel. Motion was seconded by Commissioner Hey. ROLL CALL VOTE – Commissioner Taylor - Yes Commissioner Hey - Yes Commissioner Mattix - Yes
Returned to session at 9:30 AM with no action taken and no decisions made.

LAYNE ENERGY – WAIVER REQUEST FOR PIPE ENCASEMENT: Mr. Bob Behner, representing Layne Energy and Mr. Bill Dress, Project Engineer for Shafer, Kline & Warren, Inc., met with the Board to further discuss the requested waiver by Montgomery County for pipe encasement on the line at Sycamore. Mr. Behner presented copies of approved waivers from KDOT and from the railroad. After some discussion, the Board, based on the waiver by KDOT, agreed to a waiver for pipe encasement by Montgomery County. The Board also stated the requirements by the County will remain and waivers will be a “case by case” decision by the Board. The following action was taken:
ACTION: A motion was made by Commissioner Taylor to approve a “Cased Utility Line Waiver” from Montgomery County to Layne Energy, Mission Woods, Kansas, for the Layne Energy Sycamore Pipeline, LLC. The motion was seconded by Commissioner Hey. ROLL CALL VOTE – Commissioner Taylor - Yes Commissioner Hey - Yes Commissioner Mattix - Yes RES. NO. 03-165

PUBLIC WORKS: Barbara Curtis, Public Works Coordinator, presented the weekly written report. The following items were discussed: Snow & Ice Building project; and reported on accident with pickup on State Highway 169 during the snowstorm on December 10th. No action was taken as a result of this report. Awarding of bids on the 22nd of December will be postponed until the 29th of December.

Returned to Session at 10:30 AM with no action taken and no decisions made.
Discussion: County Appraiser Bill Hendrix requested approval to hire a Field Appraiser I at a salary of $7.44. The following action was taken:
ACTION: A motion was made by Commissioner Taylor to approve advertising for a Field Appraiser I at a salary of $7.44 per hour for the County Appraiser’s Department. Motion was seconded by Commissioner Hey. ROLL CALL VOTE – Commissioner Taylor - Yes Commissioner Hey - Yes Commissioner Mattix - Yes RES. 03-166

OTHER COUNTY BUSINESS:
1. Senior Citizen Repair Recommendation –
ACTION: A motion was made by Commissioner Hey to approve the recommendation of the Senior Citizens Advisory Board for expenditures of $2,322.20 and $603.50 for repairs for the Independence meal site. Motion was seconded by Commissioner Mattix. Debit Council on Aging Fund. ROLL CALL VOTE – Commissioner Taylor - Yes Commissioner Hey - Yes Commissioner Mattix - Yes RES. 03-167
2. Christmas Eve Holiday –
ACTION: A motion was made by Commissioner Taylor to approve closing the Courthouse at 12:00 Noon on December 24th, 2003 to observe Christmas Eve. Motion was seconded by Commissioner Mattix. ROLL CALL VOTE – Commissioner Taylor - Yes Commissioner Hey - Yes Commissioner Mattix - Yes RES. 03-168
