 The Board of County Commissioners, three members and the County Clerk present, met in regular session at 9:00 AM.

CALL TO ORDER:  Commissioner Taylor.

INVOCATION:  Commissioner Taylor

PLEDGE OF ALLEGIANCE:  Commissioner Hey.

 

AGENDA APPROVAL:

 

ACTION A motion was made by Commissioner Taylor to approve the agenda as amended.  The motion was seconded by Commissioner Hey.

APPROVAL OF MINUTES:

 

ACTIONA motion was made by Commissioner Hey approve the minutes of September 8, 2003as presented by the County Clerk.  The motion was seconded by  Commissioner Mattix.

APPROVAL OF PAYMENT OF INVOICES:

ACTION:  A motion was made by Commissioner Mattix to approve invoices in the amount of $1,075.00 and $108,186.88 as presented by the County Clerk’s office.   The motion was seconded by Commissioner Taylor.

LAYNE ENERGY – WAIVER FOR PIPE ENCASEMENT:

Mr. Bob Behner, Operations Manager, Layne Energy, appeared before the Board to discuss the waiver for pipe encasement on a line from West of Sycamore to East Highway 75.  Commissioner Taylor read a letter presented by Barbara Curtis, Public Works Coordinator, stating she did not feel the waiver should be granted for the safety of workers and possibility of damage to roads. 

After some discussion, Mr. Behner said he would return to the Board with the agreements from the railroad and KDOT granting the waiver for the pipe encasement.  The Board individually stated they would be more favorable to the waiver if KDOT has agreed to waive the encasement.  No decision was made at this time.

CLASS LTD UPDATE:

Jan Bolin and Phillip Chappuie, representing CLASS LTD, presented the quarterly update with a written statistics report.

MONTGOMERY COUNTY TREASURER – REQUEST TO ABATE TAX:

Montgomery County Treasurer Billie Lewark Wood presented a request to the Board upon recommendation of the County Auditor, to abate $851.75 in 2003 taxes on Parcel #1030804011004.

 

ACTION:  A motion was made by Commissioner Mattix to approve the abatement of taxes in the amount of $851.75 on Parcel #103080401104 with the approval of the auditing firm for the 2003 taxes and to pursue the collection of these taxes through the County Attorney.  Motion was seconded by Commissioner Taylor.

PUBLIC WORKS:

Barbara Curtis, Public Works Coordinator, presented the weekly written report.  The following items were discussed:  Departmental Work Progress and a Road Vacation requested by Kirt Fryer (County Road 3200-2 & 3.  The viewing date was set for December 22nd at 9:00 AM.

COMPUTER DEPARTMENT:

Ken Collins, Computer Director, presented a request to the Board for eight (8) monitors at a cost of $289.00 each and four (4) switches at an estimated cost of less than $200.00 each.  The following action was taken:

ACTION:  A motion was made by Commissioner Hey to approve the purchase of eight (8) monitors at a cost of $289.00 each.  Motion was seconded by Commissioner Taylor.  Debit Computer Department Budget.

ACTION:  A motion was made by Commissioner Hey to approve the purchase of four (4) switches for the Computer Department at an estimated cost of less than $200.00 each.  Motion was seconded by Commissioner Mattix.  Debit Computer Department Budget.

 OTHER COUNTY BUSINESS:

 

1.       Cereal Malt Beverage License – Southgate, Independence

 

ACTION:  A motion was made by Commissioner Hey to approve the cereal malt beverage license for consumption on the premises for Southgate, Independence.  Motion was seconded by Commissioner Taylor.

OTHER COUNTY BUSINESS (Continued):

 

2.       Commissioner Mattix discussed the possibility of having an outside firm do our website.  He provided literature on the firm engaged by KAC.  No action was taken at this time.

 

3.       Discussion on issuing a check to each county employee based on $50.00 per month for the period July 2003 through December 2003.  The following action was taken:

 

ACTION:  A motion was made by Commissioner Mattix to approve a Cost of Living Adjustment to all employees based on $50.00 per month for the period July 2003 through December 2003.  This amount is to be prorated for part-time employees and those hired during this six (6) month period.  This Cost-of-Living Adjustment is the second half of a “one time” $50.00 per month adjustment. Motion was seconded by Commissioner Taylor.

 LAYNE ENERGY:

Mr. Bob Behner returned to the Board with information on the pipe encasement.  He was unable to obtain all the documents necessary and will return when he has this information.
