 The Board of County Commissioners, three members and the County Clerk present, met in regular session at 9:00 AM.

CALL TO ORDER:  Commissioner Taylor.

 INVOCATION:  Commissioner Taylor.

 PLEDGE OF ALLEGIANCE:  Commissioner Mattix.

 AGENDA APPROVAL:

 ACTION A motion was made by Commissioner Taylor to approve the agenda as amended.  The motion was seconded by Commissioner Mattix.

             ROLL CALL VOTE – Commissioner Taylor - Yes

APPROVAL OF MINUTES:

 ACTIONA motion was made by Commissioner Hey approve the minutes of March 24, 2003 as presented by the County Clerk.  The motion was seconded by  Commissioner Taylor.

 APPROVAL OF PAYMENT OF INVOICES:

 ACTION:  A motion was made by Commissioner Taylor to approve invoices in the amount of $12.365.69 and $329,667.89 as presented by the County Clerk’s office.   The motion was seconded by Commissioner Mattix.

 DEPARTMENT OF HUMAN RESOURCES – SHARED LEAVE REQUEST – SHERIFF’S DEPT.:

 Liz Schwatken, Human Resources Director, presented a written request for shared leave by the Sheriff’s Office.  The request complied with the County Shared Leave Policy.

 OUTSTANDING EXPENDITURE CHECKS - 1999 (REQUEST TO CANCEL):

 The County Clerk presented a request to cancel $66.35 in outstanding expenditure checks for 1999.  The following action was taken:

 ACTION:  A motion was made by Commissioner Hey that warrant numbers 59133, 60217, 60241 and 60258 totaling $66.35 and dated 1999, be canceled.  Motion was seconded by Commissioner Mattix.

GENERAL DISCUSSION – KCCA CONFERENCE:

 Commissioner Mattix discussed the Kansas County Commissioners Association Conference to be held May 7 thru 9th.  He would like to attend and the Board approved expenses to attend the KCCA Conference.

 COUNTY AUCTION – AUCTIONEERS BIDS:

 Gene Tucker, Montgomery County Rural Fire Director, presented bids received from auctioneers interested in the Montgomery County Auction to be held May 3rd at 10:00 AM at the school building in Dearing.  Bids were as follows:  Jim Buchanan 2.787% and Dale Rupert 2.800%.  The following action was taken:

 ACTION:  A motion was made by Commissioner Hey to accept the low bid from Jim Buchanan, Independence, Kansas at a bid price of 2.787%  for the Montgomery County auction to be held May 3rd at 10:00 AM at the school building in Dearing.  Motion was seconded by

             Commissioner Mattix.

 EXECUTIVE SESSION – ATTORNEY/CLIENT PRIVILEGE:

 ACTION:  A motion was made by Commissioner Taylor to recess to Executive Session at 9:30 AM to return at 9:45 AM with County Counselor Paul Kritz and Assistant County Attorney Larry Markle present for the purpose of Attorney/Client Privilege.  Motion was seconded by Commissioner Hey.

                                               Commissioner Hey - Yes

                                               Commissioner Mattix - Yes

 Returned to regular session at 9:45 AM with no action taken and no decisions made.

JUVENILE JUSTICE AUTHORITY/FAMILY AND CHILDREN SERVICES:

 Duane Powell, Executive Director, met with the Board to request approval to purchase a vehicle for the Family & Children Services.  This vehicle would be used for Case Managers to transport youth due to transportation funding being cut from the budget.  The request has previously been approved by the Juvenile Corrections Advisory Board.  The following action was taken:

 ACTION:  A motion was made by Commissioner Hey to approve the purchase of an agency vehicle for Family & Children Services to transport youth at a cost of $13,000.00.  Motion was seconded by Commissioner Mattix.  Debit Juvenile Justice Funds.

 Mr. Powell presented a copy of application for Juvenile Justice Authority Contracts and Community Programs Division FY2004 District Funding Request.  The original applications will be signed by the Chairman of the Board and the County Clerk as Fiscal Officer for Montgomery County when completed before being submitted for funding.

 PUBLIC WORKS:

 Barbara Curtis, Acting Public Works Director, met with the Board and presented the weekly written report.  The following items were discussed:  Major Bridge Replacement Status (County Bridge Nos. 22, 107, and 1145); Spears Manufacturing Company Roadway; Departmental Work Progress; Sewer District No. 2 (Request for recalculation); Relocating old grader from the north side of the Courthouse (The Board agreed the grader should be donated to the Antique Tractor group at Caney);  and Requested permission to remove the crab apple trees from the west side of the Judicial Center (The Board approved the removal of the trees).  As a result of this report, the following action was taken:

 ACTION:  A motion was made by Commissioner Taylor to approve the request for recalculation of sewer charges for the residence at 1803 S. 17th Street due to a water leak during the reaveraging months.  Recalculation is to be based upon 3013 gallons.  Motion was seconded by Commissioner Mattix.

 PROCESS FOR JUDICIAL FORECLOSURE AND SALE OF REAL ESTATE RESOLUTION:

 ACTION:  A motion was made by Commissioner Hey to authorize and direct the County Counselor to institute an action in district court for the foreclosure and sale of all eligible real estate sold and bid in by the county for delinquent ad valorem property taxes, all as provided by law.  Motion was seconded by Commissioner Mattix.

MONTGOMERY COUNTY SHERIFF – REVIEW:

 Sheriff Jack Daniels appeared before the Board of County Commissioners.  Sheriff Daniels stated he was “relinquishing his time to Mr. Hurschel Buscher, Attorney”.

 Mr. Buscher stated he was not representing Sheriff Daniels but did not reveal his client’s name at this time.

 The Chairman of the Board rescheduled the meeting with Mr. Buscher when County Counselor Paul Kritz would be present.  The meeting was set for Monday, April 7th at 9:15 AM.

The meeting recess at 10:30 AM and will meet in the basement of the Judicial Building for the Department Luncheon at 11:30 AM.
